Mr. Phillips again asked the Court to adjourn over the | case till to-morrow, He was unprepared with witnesses, and he was suffering himself from a severe cold; he did not, therefore, feel able to undertake the defence of this case. which involved the life of his client ‘The Court said the case must be finished this evening. Mr. Phillips then proceeded to open the case for the defence; after which he called several witnesses to prove that the colored men examined for the prosecution were known about the Five Points as thieves and persons of such character as were not to be believed under oath. Benj. B. Stookey, half brother of the prisoner, deposed to his being of « qe juiet and good dispostion and that, for two years past, he was not in his right mind; he had | & fever some time ago, which affected his mind. A witness, named Garthwaite, respectable looking young man, nephew of the prisoner, stated that he was feared by the prisoner; that he was indebted to Mr. Stookey for his position. and that he was of a mild dis- position; his mind was impaired in consequence of a fever | had had some time ago. ‘This closed the defence.
