The Compromise Dill being resumed to-day, Mr. Douglas, with a view of procuring atest vote of the Senate on the question, whether California and the territories shall be considered separately, or in the some dill, he, therefore, moved to lay the compound bill on the table, so asto take up the California bill by itself, And the result was 24 to 28—a majority of four supporting Mr, Clay’s bill, im preference to Col, Benton's scheme of admitting California by herself, The vote was the same substantially as several votes on the same question, pending the debate on the subject of appointing the committee of thirteen, with this dif. ference, that Mr. Yulee, of Florida, is so completely op- posed to thir compromise, that he voted with the North- erp minority to lay it upon the table withoat further discussion. “With this exerption, the extreme South voted against laying the compromise on the table, But this vote is not to be taken as atest. It does not do- cide the question upon the bill. It only decides that the South prefer to discuss these questions all together, to the alternative of suffering California to come in in- ly of any other question whatever. Mr. Webster and Mr. Cooper, of the Committee of Thirteev, voted to lay the bill of Mr, Clay upon the table. ‘The position of Mr. Webster is thus very clearly defined If he is opposed to the mere consideration ot the admission of Calitornia in connection with any other measure, he must certainly be set down as un- questionably opposed to the passage of the combined bill, ‘the amendment moved by Mr, Davis, of Mississippi, to the teuth section of the bill. pty clearly indicates that the compromise, as it stands, is not satisfactory to the South. According to the bill, the teuth section reads 4s follows :— Sec. 10. And be it further enacted, That the legislative power of said territory, (Utah,) shall ‘extend to all rightful subjects of legislation, ith the consticnt the United States and the provisions of this act; bat assed interfering with the primary disposal rin respect to African Slave: Davia, of Mississippi, moved to strike out the apd to insert— Nor with those rights of property which grow out of the institution of African slavery, as it exists in any of the States of this Union. At the first glance, this amendment appears to be « mere change of phraseolog: ony without altering the mean- ing of the bill;~ but there is @ wide distinetion. Ac- cording to Mr. Clay’s construction, the local luws de- scended to the territories from Mexico, excluding sla- very, remain in force, and there are no rights of pro- perty in slaves in the said territories. While the bill, therefore, does not disturb this construction of the lex loci of Mr. Clay, the amendment of Mr. Davis guaran- ties, under the supreme sanction of Congress. the rights of property in slaves in the territories. in other words, while the bill affirms nothing, the amendment of Mr. Davis recognises or ertablishes slavery in the territories Mr. Clay, of course, argued that this amendment was rfluous, or else mischievous in its tendencies. Mr. Jefferson Davia and Mr, Yulee contended that it was demanded by the necessities of the case, Mr. Foote, as a Southern man, and as a friend of the compromise, occupied @ very ticklish position on this amendment.
