Whe Astor Place Miot—Trials ef the Ae euscd. ‘The September term of the Court of Sessions ie this city promises to be one of the most import- ant and interesting that has been held for many years past. In addition to the tnals of the awmerous parties who have been indicted by the Grend Jury for bringing about the mot at the Astor Place theatre, which resulted in the death of twenty-five persons aad the wounding of a great many more, several important hbel cases will, in all probability, be adjudicated, as well as an io- finite vanety of petty-larcenics, burglaries, main- Ings, woundings, and talse pretence cases. The petit jury that have been summoned for this term will, therefore, have their hands full; and we doubt very much whether they will be able to get through all the business thut 1s before them, before the term chall huve ended. Among the first cases that will be ealled for trial at this term, which commences this day, will, we understand, be those of the Astor Place sioters—of the noters who excited the mob on the melancholy night of the tenth of May list to at- tack the ftalian Opera House, and assail the mi- litary. Those trials have been anxiously waited fer by the publie; and the distriet atiorney owes it to bimeelf, to the friends and relatives of those who were shot down on that occasion, as well as to the whole community, to make a searehiag in- vestigation into the matter, ‘oad to proceed with as much celerity as is consistent with the ends of justice, and with the trial of the accu-ed parties. The Recorder, from metives of delicacy, will not ‘Wwe understand, preside on the beach during those tivls, which are expected to commence this morn- ing; ner would it perhaps be becoming in him to du 60, for be was at the scene of the slanghter, in hie official capacity, and exerted himself in pre- serving the pecce on the night referred to. Judge Baly will take his place—end from the character the charge which he delivered to the Grand Jury, when that bedy were abont to take the sub- yect into their consideration, we are satislied that, #0 far at least ag he 1s concerned, the law will be vindicated, end even and exact justice meted out to the accused. If we are not much mistaken, there will be some very strange developements made during the progress of these trials—developements uflecting as well the city authorities, throughjwhose waat of prudence where prudence would have been of avail, end through whose timidity and weakness, where energy and determmation would have pre- vented aay riot, the lamentable and deplorable ca- tastrophe, the deaths of twenty-five citizens and the wounding of a great many more, were caused. They succeeded ia staving off those trials tor a leng time, with the hope of eventually being able to stifle them entirely; bat the public indigaantly denounced all euch attempts, and demanded that the inals should be proceeded with. We are informed oa goed authority, that one of those persoas deliberate- ly prepared hnuself for the occasion—that he ehanged his apparel on the eveniog in question, with the view of disguising himeelf, and Likewise armed himself with two pistols and a short sword, no doubt with the premeditated design of using them and avoiding detection. All these matters, we hope, will be fully and clearly exposed to the public eye. We assume to be a people goveraed by lews of ovr own making. If these laws, which every well dispored citizen has an interest in maim- taining, have been broken, Int those who set the at nought, and who, 1m connection with the ineffi- eicavy of the éity authorities, directly pronght on that melaneloly catastrophe, be punished as thoee laws dircet. When all the testimony shall have been elicited, and the verdict of the jury rendered, the supreme tribunal of public opimion will after- wards pass ite judgyent on all coneerned. Ip another point of view these tnals are of the Rimost importance. Thet was the first time that the miliary bad beea called upon to fire ball car- trifgeson the citizeas—to take life in preserving the peace of the community. We owe it to posterity, wrefore, as weil as to the present generation, that the investigation should be as compreheasive and as clear as possible, so that future mayors, mag trates, and other municipal dignitaries may know the ground on whi troud, in case of a repe- tation of any such disturbances, and so that their duties may be clearly and defiaitely defined. We shull report these trials fally, from day to day, in the columns of the Herald, for the benefit ef our readers, Fioeeine in Tan Navy. opinion is ra, pidly arriving at the conelusion that the progress of eivilization, of the principles of hamanity, and the interest and promotion of that braneh of the public servies, demand that flogging shall cease to be in- flicted on the marines of the American navy. The propriety of putting en end to this brutal and de- gracing punishment, has been zealously discussed throughout the country for a year or two past, and if we are not much mistaken, it will be certainly abolished during the next session of Congress, and ‘a better and more efficicat system adopted ia its stead. Flogging in the navy would have been dispeased with Jong since, but for the influence of a clique of old fogics connected with the service, whose ideas ‘on this, and al:nost all other eubjeets, are completely behind the age. They imagine, we euppoer, that because the sattan was freely uséd in seademies and echools when they were youngsters, by pa- tents in rearing their childrea, and that the use of the eat prevailed in the navy whea they joined it, that therefore flogging can’t be dispensed with, without manifest injury to the services. This kind of argument will not do, They forget, or do not know, that the rattan has loag since been driven at of echools and seminaries of learning—that parenis use moral suasion and kinduwess instead of the rattan in bringing up their children, and that yh the penitentiaries and state-prisons throughout the country, the whip is seldom or ever used.— Other and more effectual meens of pumshing the disobedient or unruly, are adopted—the principa one of which is, in state prisons, the shower-bath, the use of whichdoes not degrade aman in hi own estimation or that of his fellows, which do not leave its stripes and marks after it, and which has never failed to bring the most incorrigible or an- rvly reprobate to terms and submission, few requir ing more than a second application, Why could got a similar system of punchment be adopted in the navy 1 The old fogies referred to, would per. haps denounce it at onee, as childish, and asa use- less punishment, bat the ex; nce of our state sons shows the reverse. It was proved in the squadron which Commodore Stockton commanded in the Pacific, daring the war with Mexico. |uring the whole ersise, if we are cor- rectly informed, the lash was not resorted to single inetance, and yet there wae no want ot eipline—no disobedience of orders. On the con. squadron wae in the higher? state of efficieney during the whole cruise, the men per- | formed their duties cheerfully, obeyed their orders implicitiy, and a feeling of kindness and brother- | hood pervaded the whole squadron.
