Aa effortis being made on the part of certain friends of the last administration, to smooth over the protocol affair, and induce the public to believe that the present cabinet concurs in the postion taken by Mr. Buchanan upon that celebrated, or, rather, notorions, paper. ‘The Union, in noticing the remor that the Mexican Congress had disagreed in the view taken of that measure by the Mexiean minister here—and consequently agreeing with Mr. Clayton's proposition—congratulates itself upon the fact, and gives the parties wno first dragged the protocol to light a delicate slap en passant. Mr. Senator Foote, too, iv his long letter to Mr. Wise, at Mr. Benton, takes occasion triumphantly to says That the. new administration of General Taylor, after a thorough scrutiny of all the facts, with true American fecling (I au not afraid to do thom justioe,) refused to sustain Mr. Benton in his protocol mow ment, and nobly resolved to maintain aad vindioat the course.and policy in reference to this grave mat- ter, adopted and prosecuted by the administration of Mr. Polk; Mr Clayton formally sending for me (thie much [can say without vielating senatorial seoreey,) and authorizing mo to declare for the new adminis tration their determination in this respect, and ae- tually handing mea resolutivn, drawn up under bis direction, assertive of the vaiidity of the treaty.” We cordially detest humbug in any shape, and cannot, theretore, permit such statements as the foregoing to pass without a word or two of expla- nation. ~ Mr. Clayton was one of the priacipal movers in the Senute against the protocol ; and it can searcely be beheved that the fact of bis beia: invested with the office of Seeretary-of State couli change his judgment as respected that document. | The protocol, which professes to be an explanation ; of the amendinent made to the treaty by the enute, declares in effvet that every article whw was struck outis just as much in force ag if it hed remamed. The correspondence was no secret here ; the Mexicun Minister having sent copies of it, as we understand, to the different toreign ministers. Senor Rosas, adopting Mr. Buchanan’s grouad that the treaty and the protocol were one und the same thing—neither conflicting with the other— proved that, under the ‘protocol,” all the em- preesurio grants were in full force, and broadly inted that still greater concessivas could alse be entorced under it. To this communication Mr. Buchanan made no reply, and the Senor boasted that he had cornered his antagonist. Thus mut- ters stood when the present administration came into office. And now comes the portion of * his- tory” which Mr. Foote has touched upon, | _It will readily be believed that the Mexican mi- nister felt desirous of pushing his supposed ad- vuntage, and procuring from the present cabinvt an acknowledument of the binding character of the protocc|. His imagination Moubiless revelled in the idew that two-thirds of Califuraia and New Mexico—not to speak of ‘Texas—would have to be delivered over to Mr. Macnamara, and the other | fortunate owners of the “cmpressario” grants. The ‘protocol, | if a binding document, guaranteed all these blese- ings—und binding the last administratioa had de- clared it to be; ouly they differed as_ to the proper | interpretation of its clauses. Mr. Clayton at ouce | took the stand that the treaty, as ratified by the Senate here and the Congress of Mexico, was all that was binding upon either country; that he was prepared to curry out its provisiona in good faiths that under it the Mexican government Fail already received several instalments of the fifteen millions we were to pay her; and that the “protocol” was known, at the time 1t was drawn up by the Ameri- can commissioner and the Mexican government, te be merely a piece of waste paper, uaconstitattoual upon its face, and insincere ‘in its character. It was in fact a ruse suggested by the Mexican go- vernment to blind their owa people, without a thought that it was to be considered asa part of the treaty—that, even were ita part and parcel o the treaty, it amounted to nothing, because it guar rantied what wus in direct violation of the o}asu- tution of the United States, namely, a State reli- gien, and it revived grants which could not be claimed under our laws—thut it is the daty of all governments, in making treaties with other powers to make themselves acquainted with the constite tions of those countries,und that no unconstitution- al provision is binding in any treaty. Senor Rosas wus silenced. Heatonce forwarded the whole ot Mr. Clayton’s correspondence to his own governments and as Mr. Foote acknowledges that government, seeing the high ground taken by the American cabinet—knowing thit the protocol was not bind- ing—and despairing of bullying a goveraxent pre- sided over by the hero of Buena Vista, at once ac- quicsced in Mr. Clayton's views, and so the matter is settled. What reason the last administration has to congratulate itself for bringing this about, ig a matter which we confess we cannot compre- hend. Had Mr. Clayton followed out Mr. Bu- | chanan’s course of argument, we can readily un- | derstand how easily we might have become ia- volved in a disgraceful position, aad our national honor tarnished. We will have no more © protocols” to be discovered mercly by accident—no secret negotiations for the purchuse of countries—in a word, none of that Metternichian diplomacy which, however neces sary in despotisms, is utterly beneath our character: and position. It is our pride to boast of the sin- plicity and freedom of our institations.
