There were large sales of all the fancies, and the bears effered any quantity of stock; but the bulls have lost much of their copfidence in an immediate rise in prices. Money is not so plenty as previously reported. '; The drain upon the banks for specie is tightening the anarket; and if the demand for coin continues for any “Jength of time, at the rate realized during the present week, the fenoies will drcp eff several percent. Yester- day, more than two hundred thousand dollars were paid into the Custom House for duties, being the largest amount paid in any single dey; and to-day the payment, amount te more than one hundred thousand dollars, making nearly three hundred a fifty thousand dollars, drawn principally from the banks, in two days. They will, doubtless, be much admired. The eloquent Mr. Lump- kin, M. C.. also shone out trom the canvass very lite-like. The question of the constitutioaality of laying a tax on foreign immigrants having heretofore been | argued before the Supreme Court, Justice McLan® this morning delivered the opinion of the court.— I; was concurred in by Justices Catron, Wayne, McKinley, and Grier, the Chief Justice in many respects dissenting. Some or the points held, we understood to be as follows: The law of NewYork levies a tax of a dollar and fifty cents on alien pas- sengers; the money thus collected goesin part, to the Marine Hospital—the overplus is appropriated for the reformation of juvenile quents. The money might, with as much propriety, be appropriated tor the support of the criminal courts as tor the reformation of ju- venile delinquents. Congress has passed laws allowing two passengers for every ton bur- den, and the constitution says that “ no preference shall be given by any regulation of commerce or revenue, to the ports of one State over another; and, again, that Congress shall have power to “ re ee commerce.” Congress has passed laws to lay imposts on merchandise, but not on passen- gers, who are plainly not articles ot merchandise. The law ot the United States requires captains to report to the collectors of the ports the number of passengers brought over in their ships, their places where born, and their ar penesnes t only eo tar as has been considered expedient.
