Preventing crime is of mucg congequence, and it perbaps better, generally speaking. that magiatrate: should, where there is prehension, prevent crimes, than wait until crime is committed. The law, as [ take it to be, however, when a warrant has been issued, makes it the duty of the magistrates to examine (unless the crime be committed in their prerence) whether the crime has been committed, and into the cause and probability of suspecting @ crime; and it is the duty of the magistrate well to con- sider the evidence sworn to. * * * Sofar from finding fault with the magistrates in this case, [ commend them. If the Court had any ground to go on, it would hold Colonel Benton to bail; but there is & total absence of everything like proof. Whatever might have been intended on either side, the Court knows nothing but that a quarrel or excited language occurred in the Senate chamber. Subsequently, there was not one act of Col, Benton on which the Court ould lay its hand. In cases of crime actually com- mitt«d. the Court never discharges on habeas corpus ; the writ is granted only when it does not appear, from the evidence, that the Howey has committed the crime. ‘The quarrel! did take piace in the Senate chamber, and language was there made use of which, no doubt, all parties regretted. Beyond that, there is nothing what- ever to hold Col. Benton, (You may hang the best man in the community, if you take the opinion of some peo- le.) ‘Therefore, Col. Benton must be discharged. The above is the substance of the opinion of the Court. The Sacrifices of a Congressman— Stationery—Mending of Trousers—A Vessel from California—Secretary Waiker, etc. ‘We have heard members not unfrequently complain of the sacrifices which they make in coming to Con- gress. It must bein “ character,” for the pecuninary part is not to be despised, Computing a Congress, a long and short session, tobe fifty weeks, at eight dol- a day,"a member receives, in per diem, $2,800. If he live as far offfrom Washington as the Louisianians or the Texans, he receives about $5,000 mileage; the two items $7,800. The expenses of @ year's living in Washington $1,000, and actual travelling fees $500; leaving $6,200, or $6,000 for the “sacrifice.” Of course other members, llving nearer to the seat of govern- ment, donot receive so much; the great gain being in the overplus of mileage. Besides the above mention- ed, new members receive $760 worth of books. Be- tween $8,000 and $9,000 will be thus expended by the Clerk during the recess. Twenty-six dollars are al- jowed forstationery for a long session; this arrange- ment was made to prevent “‘stealings.”’ It is well known at the capitol, and should be to the country, that not afew ofthe members have for some years paid their tailor’s billg with a check on the postmaster, under the plea of “ stationery” furnished. This is al- most, if notquite,as bad as the charge of Governor Marcy, although he asked but fifty ceuts for the seat of bis pantaloons in the public service. The people are good natured, and make no‘complaint of their re- presentatives for overpaying themselves; but it is their duty te hold them to a strict aecountability A Georgia member.in the presence of others, said, on the Saturday before the adjournment, that ifthe people knew what plunderings were going on, they would rise in their majesty, and tumble the members neck over heels cut. Andanother, from Missouri, remarked, in speaking of the change which his eonseience had un- rgone, that when he first came to Congress, he would not even write a letter ona government sheet of paper to his wife. ‘There is on the stocks, at Easby’s shipyard, a ten un brig, built at the expense of the government. She #8 ker masts in, and is full rigged, and will be ready for launching on Saturday. We were repaid for a two hours’ walk, in the hot sunshine, by a sigat of this beautiful vessel. She is intended for the revenue ser- vice, on the coast of California. Captain Alexander Frazer. head of the revenue marine, is togo out in her, to set the treasury department in operation in the far- off country. A more persevering and talented man in this branch of business can nowhere be discovered. Secretary Walker was a little better in health to-day, His physicians ay that he must go to a watering place, and that Cape May would be beneficial. The Presi- dent, on Friday, will, it is said, evacuate for a few weeks, leaving Mr. Buchanan in possession of the gov- ernment. ‘The poor fellow (Adam Alburger) who died yester- day, inconsequence of wounds received by the ex- plosion of percussion powder, at which he was working on Monday, was buried this afternoon. ‘We saw but one solitary member of Congress in the cars this afternoon, homeward bound, for cis Bartimons, August 17, 1848. The Voltigeur Encampment—A Mexican Wife—Heaith of the Regiment—General Taylor's Letter—Whig Party Defunct, sc. The encampment of the Voltigeur regiment, at Fort McHenry, was yesterday visited by a great number of our citizens, and those who had relatives in the city were abundantly supplied with the good things of life, from the hands of mothers, wives, and sisters; their visits to the encampment furnishing many affecting scenes during the day. The Voltigeurs have seen very hard service, and more than of the original 900 members have re- turned, the remainder of their present 700 having been filled up by recruits, after arriving at the city of Mexico. One of the boys has brought home a Mexican wife with him, and a little girl, her daughter, about six years ofage. What he intends to do with them, I do not knew; but they seem toleral well satisfied. In meking bisselection of a wife, he certainly not dis- played much goed taste, as she affords but a poor ape- cimen of the “fair Senoritas” we have so often read of. ‘The little girl, however, is a beauty, and when she ar- rives at womanhood, bids fair to be a credit tothe feminine beauty of her country. The whole regiment is in good health and condi- tion ; indeed but few of them show any evidence of physical debility, notwithstanding they have just nded after spending five weeks on shipboard. They will be discharged in about ten days. Our whig rs refuse to pul the last letter of General Taylor to George Lippard, Esq., in which he etill ‘ts that he is not the whig or any other party candidate. The old fellow seems to be determined to maintain his own consistency, notwithstanding the ble inconsistency of his whig friends in nomi- nating him. The fact is, that Henry Clay and myself are the only two whigs in the country, and we intend to walk to polls with all the solemnity of a fune- ren @ terrible and broken sigh over the untimely death of the whig party, as we bandin our ballots for General Taylor. Our small potato politicians, especially those who are looking about for nominations by the democratic con- ventions as candidates for various offices they havea hankering after, are now brim full of Irish patriotism, and the silliest speeches are given utterance to at the gatherings held throughout the country; which of course are received in perfect faith by the great mass of those who attend. The Irish are portrayed with superhuman qualities in these speeches: and a few evenings since, one of the speakers, while wr | his cag ol and advocating the purchase of A! > oan rifles, said—< Let hedge with a good rifle. and God hi which would come within « mile of him.’ Jeremiah Nicholls was run over in Chestnut street, during the fire, by the Hope engine company, and was taken to the hospital. The office seekers are also taking advantage of the excitement among the factory operatives, in favor of be ten hour law, to profess © sympathy with them, n order that their votes may be secured on election day. A large meeting of operatives took place last evening, in Independence Square, which was largely attended, and the usual amount of sympathy was ex- pended. The law passed by the last legislature, thus ar bas been rather an injury than a benefit, for, un- dcr ite provisions, the proprietors, finding that they cannot compete with the manufacturers of other Sin ca, are suspending operations entirely. Did he prove that he didn’t cbew tobacco? ‘Was he very good-looking ? or did he show up the de Vargent? or how did he show his high respectabili- ty?” The latter commodity, we should suppos, would have decidedly the most effect, generally, upon the minds of the police towards establishing the high re- spectability which is necessary sometimes to ex- hibit in the police station-houses—especially if a portion of the Vargent is judiciously expended, It makes men feel good and tends to spoil thememory cf witnesses. Vargent! thou art a treasure | ‘Thou canst do wonders! ‘Thou canst open doors, as Well as close them, Take it altogether, Mr. Belamber may thank his lucky stars that he was enabled toshow his “ high respectability ” sufficient to procure his dis- charge, or he would surely have been broaght before a magistrate, and made to suffer. Charge of Robbery.—Oficer Welch, of the 1st ward, arrested, on Wednesday night, a notorious fellow, call- ed Edward Lynch, more commonly known as the “Dub- lin Pet,” on a charge of seizing a young woman, by the name of Sarah Greenwood, residing at No. 105 Wash- Ington street, by the neck, and forcibly tearing off her necklace, worth 60 cents, and was in the act of forcing off a gold ring from her finger when, the rascal was ar- rested by the police, Justice Lothrop committed him to the Tombs for trial. Kobbing a Stranger.—The police of the Sth ward ar- rested, yesterday, two belles of the town, called Kate Hays, alias Jane Rice, and Elizabeth Comstock, both residents of No, 104 Church street, on a charge of rob- bing Albert Peirson of $25, under the following cir- cumstances:—It seems Mr. Peirson called in at No. 104 Church street to see the accused parties, where, after fooling about him a short time, they extracted from his pocket two $10’s and a $5 bill. On missing the money, he made a muse, when the girls, thinki to make the thing smooth’ again with him, put bac im his pocket $15. ‘This plan, however, did not fit, as our stranger thought $10 was too much to lose with- out any value received; therefore, he applied to the olice for assistance, who brought both the women fore Justice Lothrop, who took the complaint of Peirson on the charge of larceny, which resulted in the females both being committed to prison for trial at the Speeial Sessions, this morning, at 9 o'clock. Law intelligence, Genera Sessions, Aug. 17.—Before aN Daly and Aldermen Stevens and Crolius.—The trial of James Driscoll and Richard Pierce, for assault with intent to kill police officer McVettie, was resumed. The chief defence put in was, that prisoners felt themselves jus- tified in attacking the officer on the premises belonging to Pierce (the prison 1). The third story was used for folding and packing the weekly paper pub- lished here, “dlezander’s Express Messenger,—the whole establishment belonging to Col. Alexander, the veteran newspaper publisher. In tbe third story there were also several valuable hydraulic and othér presses, besides a store room, full of valuable wood cuts and sale- able books, and the mail books of the newspaper, and business books of the establishment. These being in a fre-proof, weré soon saved. ‘The second story was used as the composing room of the paper and the job printing office. The first story was the celebrated lead-Quarters. The third and fourth stories were greatly damaged, the roof destroyed, and the whole building much “injured, Col, Alexander's establish- ment was burnt out some time ago, and he had scarce- ly recovered from the derangement of his business, when this new shock fell upon him. We believe him to be insured to the amount of his loss, although we ve- are not certain, The building is owned by Mr. Wine- brenner, of the late firm of Robb, Winebrenner & Co, He is doubtless insured.—Phila.
