It further pro- vides that no company shall commence mutual insu- rance business in the city of New York uatil it shall Teceive at least 100 applications for risks of at least $2000 each; and if located in the city of Brooklyn, Al- any and Baifalo, until 100 applications for rieks, of $1000 each; and if inany other part of the State, until at least 50 applications for risks, of $590 each, are obtaiaed | No fire insurauce to be made upon any building to be greater than seventy-five per cent of its value. The fonds of these companies may bo invested in benda or firet mortgages on real estata, at fifty per cent of its value, also iu New York and United States stocks and stocks of ineorporated cities in the State; marine in- surance companies to have the privilege of loaning on bottomey and rerpondentia bonds. The companies are to hold such real estate as thoit business accommo- dations demand, or such as may be mortgagod for loans evieusly contracted, or which may be conveyed in Satisfsetion for debts, orsuch as may be purchased at sales upon judgment, decrees or mortgages for debts due. All real estate not mesessary for the business ac- commodations of the company, to be sold within six years after acquiring title. Al nual statement to the Comptroller is required of the swount of premiums received, losses paid and as- oertained, expenses, seourities representing the capita! stock, the value of the samo, and a list of the stock- holders, If the losses and expenses have excreded the premiums, so that the capital is impaired to the amount of twenty percent, the Comptroller is to require the stockholders to make the deficiency good, under penalty of forfeiture by the company of the stock held by them: Until the deficiency is made good, no new risks to be taken, violation of which involves forfeiture of charter ‘and personal responsibility of the directors, they being responsible for all losses asoruing upon such insurance. Any company already organized may at sny time, with the writtom consent of three-fourths of its etockholders, extend the duration of its charter twenty years from the time of its expiration, by altering it in accordance with the provisions of the general law. It also provides that dividends shall not be greater than eight psrcent perannum, un'ilthexet earned pro- fits aro equal to one half of the capital stock; nor above ten per cont umtil the net earned profits are equal to twice the capital stock ; no dividend to be declared when the capital stock is impaired, and no dividend to be mde that will isapair the capital stock. Itis argued by some that the stockholders of insu- rance companies should be exempted from the perronal liability elause,on secount of the risk attending the bu- that while the success of barklog and other cor- depends almost entirely upon the skill, pru- donee and fidelity of its officers, the suceses of insur- ance eompaniss js dependent more upon chance than the exerciev of round judgment or prudence, This is a great mistake. If company hazard the whole, or half or oven one-third of its capital upon one risk, ons, or two, or three carualties may ruin it. But the rnin in this caso would orieo not from the fact that the business is one of risk, but from want of prudence ou the part © the offcers of the company. This is too often the case for the safaty of the insured. ‘There are now more than two companios in the eity of New York, which in se- vernal instances have lind over $60,090 at one time, on one ship and hex cargo. But it must aleo be borne in mind that nearly all, (say 74.) ofthe marine premiums, are payable by notes, either at 4,7 or 12 months, and the oustom hea been established within the last few years, to take the notes of customers with- out other endorsement than that of the maker, or one of the firm, so that in the course of a fow months’ busl- ness, more than half of the assets of the company con- sists of notes of customers, with their own endorss- mente.
