At this, Sem nodded consent, and leftthe court room on his m-ssion, feeling oe with the authority just invested by the megistrate. The French sailor was requested to sit down between the black rascals who were brought in a8 nocomplices, who wers held as hostages, uutil the re- tora of Sam; but whether Sam returned, we were unable to loarn, and ia all probability he aid vot. ‘The next prisoner called was Hugh Tiverman, who ‘was arrested by officer Watson, of the 6‘h ward, charged with being drunk and disorderly. Maaistxatr—Well, Hughy, what do you say to this charge? Prison ‘Well, Judge, Vil tell you how it was. Macistrate—Thai’s a very good story for you to tell, Hughy, but [ don’t believe it, as eimilar stories are told daily avainst cMceis without any foundation; therefor I shall fine you one dollar for being drunk and disor- derly. Pirsonex—Dll be d—d if ll pay one cent ! Macistratk—Well, take him down, officer, and we'll keep bim in fivo days to work it out j ‘The next case that attracted the attention of the ma- jatrate, was two women. called Mary McLaughlin and Storia Lovejoy, both exhibiting bloated red faces, show- ing evident signs of dissipation, mixed up together with tb«S destroying element called rum, One of them spoke up and seid: “Judge Osborne,we are sick, and want to go up town for two months.” (Meaning the penitentiary.) “ Very well,” said the judge, “take a seat over there,” pointing toa lot of other loafers,“ and wait until Col. Snow comes, our vagrant clerk.” ‘The next case was four young literary thieves, called Jamies Wileon, Patrick MoCready, James McCready, and ‘Thomas Garvey, all boys between the ages of 9 and 12 years, who were arrested by officer Stowell, of the 4th Ward, having been detected in the act of stealing from the premises No. 11 Sprnos street, 500 copics of the 1 lustrated Magazine, the property of N H. B Smith, whose premises the young rasosls had broken open. ‘The books were recovered in a basemei the south- wert corner of Fulton and Nassau stre where they had bren depesited by these thieving news-boys Jus- tice Osborne mitted them all to prison, prior to their being sent to the Houre of Refuge. Recovery of Priperty.—A teiegraphio despatch was received yesterdsy)by Justice Osborne, from officers Zell and Ridgely, of Boltimore, netting sorth that a Jew by the namecf'L. Z Wustoer had obtained a lot of segara, valued at $300, Movin om A. & I. Caught in the “ct.—A man by the names of John O'Brien, wan d-tected yesterday, by one of the h board of ihe Ney Brighton steamboat, raoning Staten Islond, iu the ect of csrrying off a burdle con- taining dry goods, valued at $30, the property of Mr. N. Decree of Surrogate af- firmed The People ex ret Benjamin Griffinys. The Centenary Methodist Episcopal Church of Brooklyn.—Motion for a peremptory mondamus, because of the insufficiency of a return to an alternative writ. The defendants were or- Eh anized us a religious society, in connexion with th @Methouist Episcopsi Church of tho Uaited S:ates, sub- ‘fect to its discipline. It was formed of members of three ‘other Methodist Episcopal societies; and by collections made from Methodists generaily, they built a meeting house and parsonage. For eight years they received their ministers trom conference, agreeable to ths prac- tice of that persuasion, Their’ minister, appointed in 1846, haying been suspended by the church authori- ties, a majority of the male members of the con- are ‘determined to retain him as their preacher, contrary to the discipline of the church, and refused to admit the relator, an ordained elder, who had received & regular appointment as their preacher, from the pre- siding bishop at the covfrrence heli The iti of their preachers is # well established rale of church, aud that their practice of enforcing tl rancy by means of tho action of tho bishop, stat the preachers without regard to their wishvs or th« the congregations, is not contrary to law. That the Cen- tenary M. £. church in Brooklyn, having been organised in cennection with that society at large, is bound, so long ea the connection continues, by the“ doctrines and discipline” laid down for the government of the church atlarge ‘That their meeting-house and parsonage, hay- ing been built by contributions from Methodists gene- rally, and for the use of @ Methodist Episcopal con, tion, it is not in the power of the trustees to divert hem to any ot! purpose, or withdraw them from the subordination wi was voluntarily assumed at the es- tablishment of this society. Thatit is no excuse for the trustees to allege that their action bas been sanctioned or governed by @ msjority of the males now worshipping im that houre, it being their duty, as trustces, to take ‘charge of the termporalities of the society, and see that they are faithfuiy eppropriated to the uses intended by those whoss ben v lence founded and endowed the eburch. That they erred in refusing admittance to the relator, who had been duly appointed their pastor agree- able to the well establisbed discipline of that persuasion. ‘That it is the duty, and has long been the practice of this court to enface the rights thus established, and that with regard to ministerial officers and corporations, it is compete for this court not only to direct them to act, but dir the manner in which they shall act.— Therefore, a peremptory mandamus was awarded, com- manding the defendants to admit the relator to their pulpir and parsonage. Cowven vs. Fitzgerald.—A suit in equity, involv. ing an examination of long accounts, is properly Tefera- ble, it being one of thcse cases which, in the language of the judiciary act, have heretofore been usually referred to any clerk, master in chancery, or referee. Livingsion vs. Fitzgeraid.—A motion for an attach- ment against the defemdant, for not appearing before a referee aud making an assignment to a receiver, and for not paying the eosta growing out of his default. Held that the act of 224 November, 1847, forbidding the im- prisonment of avy pereon for interlocutary costs, does not apply to those cases of cmtemptes where a party ma; be fined, for any misconduct productive of an actual Joes or injury (o th cher party. Common Preas, Jan. 31—Before Judge Ulshoeffer.— Albert G. Clements et al. vs. Wm. Waln Drinker and Leon Villiers. —Thia was an action of trover to recover the value of thirty-two boxes of eegars, It appeared that in January, 1847, the plaintiffs purohased the ars and pnt them on storage with @ person named ler, in Courtlandt street, with directions not to give them to any cne but toa Mr. Lockwood, except on ® written order. ‘The plsintiffs alleged that the segars were afterwards stolen by a perton named Palmer, and by him sold to the defendant, who keeps a segar store in Broadway. at $12 thousand for cash. Subsequently the p'aintiffs arcertained where tho segars were, anit they procured a search warrant from Justice Drinker, and had the defendant's store searched; the segars were found and brought to the police office, and a complaint the pl the defendant's counsel asked fur ground thet the proof did not mai either of the defendante. The arsessed value ot property inthe Stat: New York, for the year 1847, was $630,659,056—ot which $509,496,855 was real in ostate, and $121,162 201 personal propsrty. The whole amount of State and county taxes, in 1847, wes $3,740 339, It appears by the messege of the Governor of Louisiana to the Legislature of that State, that the public indebt- edness on account of the Citizen’s Bank is $7,071,516.— To liquidate this amount the bank holds mortgage secu- rities amounting to more than fourteen millions of dol- lars, which the Governor thinks more than sufficient to protect the State against any loss. ‘The treasury of the State appears to be ina flourishing condition. There was a balance on hand on the 3ist of December, the close of the fiscal year, of $294,328 31. Durfng the pact year gold dust and bars to the value of $20,000 were sold in Wetumpka, Alabama. This is generally good evidence of the strength of the concerns; but the im- provemen’s in the movement of the banks within the past two yexrs, is the best evidence, as it shows that the dividends have been actually earned before they were declared, The line of discounts is about fitty per cent more than the capital, and the circulation about three aadahalf times more than ths emount of specie on hand. The people of the State of Indiana require an institution like the one above referred to, and the at- tempts made in the Legislature of that State, every ses- sion, to wind it up, are uncalled for and unnocessary.— The branches of this bank are distributed to every sec- tion of the State, and give the people a sound and safe currevey. The State Treasurer finds it very convenient to borrow money of the bank to help the publio finances out of the embarrassments they have been and still are surrounded with, and the bank has invariably alded tho State whenever called upon to the extent of its ability Since the partial resumption of the payment of interest on a portion of the debt of the State, the bank has been obliged to make a loan to the State Treasury, to enable the government to meet its financial engagements. Tho State bank system, when the branches are properly dis- tributed, is the best for the smaller Western States, or for those States which are almost entirely agricultural, like Indiana. Within the past thre® years there have been great changes in the other leading departments of this bank and branches. The amount of speoie on hand in December, 1847, was $861,104 greater than in January, 1816; while the increase in the circulation has been only $203,320.
