Aiwany, Jan, 28, 1848 The Arrest of Pugitica Maven. tn the Senate this morning, Mr, Fine, from tie Committe on the Judiciary, to which was refer- redva certain bill providing that ne sheriff or con- stable in this State shall detain or arrest a fugi- tive slave, made the following important report against the passage of the bill. The Judiciary Committee to whom was referred o bill entitied ‘an act for the protection of personal liberty,” beg leave to report that they have read and considered the bill. The clause in the constitution executes itself, and requires no aid from legislation, State or national. The pational government, in the absence of all positive pro- visions to the contrary, is bound, through its ewn proper departments, legislative, executive, or judiciary, to oarry into effect all the rights and duties imposed upon it by the constitution. The legislation of Congress on this subject supersedes all State legis'ation, and, by implica- tion, prohibite it. The power of } a ‘ion in relation to fugitives from labor is exclusive in the national legis- lature, Jt is very clear to the committee, from the above deci sion, which, being upon a clause of the constitution, is the supreme Jaw of the land, that any and all of the sta- tutes of this State, upon the subject of fugitive slaves, are unconstitutional and void, and are no more then blank paper. y The question remains to bs considered, whether Con- grees Can vest in the State magistrates, and sheriffs, and constables, p:wer to execute the act of 1792, as is at- tempted to be done by that act. This question has been deliberately considered and decided by the New York Supreme Court, in case of the United States vs. La- Rey 4. Congress cannot vest judicial power of the United States, except in courts establ'shed by itself; no part of the ori- inal diction of the United States can, eonsistently constitution, only in those cases State tribunals national authority, can they now exercise # concur- rent jurisdiction? ‘As regards crimes and offences, made by legislative enactment, the government of the United States stands in the same relation to the State governments as foreign government; theact of Congress may reach offender, but the State courts cannot touch him. The government is, in fact, paying off its old debts, while it is about entering into the wone. We see in this the evils of the treasury note system, and there is no way to avoid them, but by negotiating ® loan in the really le- gitimate way. 80 far as the movements of the Com- mittee of Ways and Means are concerned, we give them credit for nothing else than a disposition to embarrass the financial operations of the government, and to force it, if possibl: into a repeal of the most important measures of the country. This committee has, perhaps, unwittingly fallen upon the very method the Secretary of the Treasury prefers to all others; and if s loan can- not be negotiated upon the terms proposed, the commit- tee have assumed the responsibility. In times like the present, when the money markets are in avery embarrassed condition, when a drain of bul- lion exists for shipment to Europe, it beeomes neces- sary to adopt such measures as the exigencies of the moment require, and if s loan cannot be negotia- ted in one way, it must be in another; if a loan cannot be made must be made by or small sary to of the raise rnmen by @ direct issue of stock, it an issue of Treasury notes of large denominations, whichever may be neces- e amount required to meet the wants It does not follow that if aloan can- e made by a direct issue of stock, that the specie lause of t Independent Treasury should be repealed. ‘There are more ways than one to raise money; and the banks have less control over the finances or wants of the government then they or thelr organs imagine. As much opposed as we are toan issue of Treasury notes of small denominations, we would rather see them in cir- culation than have the Independent Treasury act al- tered or modified in the slightest degree. It would be better for the country to have it deluged with Treasury notes than to repeal the Sub-Treasury, and have it de- luged with bank notes. it may become ne If there is no other alternative, ary to choose between the two. Fortunately, the government have the control of this matter; fortunate for the commercial classes, the manu- facturers, the agriculturists, and even for the banks themselves, there is not the slightest probability of the Independent Treasury bsing modified or altered in the most trifilog negotiate a stock points, It would be preferable to loan at a discount, then to dis- turb the operation of this important conservative ryatem. It would not be thirty days after the repeal of the independent ‘I'reasury act before the banks would be on the high road of expansion, and they would inflate credits, prices, speculation, and, fora time, | produce a very fine state of things; but where would they stop? where would be the check upon them? Prices for manufactures, and for merchandize of every description, would manufacturers of become so much inflated that the Europe would deluge our markets with goods of every description; prices for breadstuffs would advance beyond shipping points, and no ship- ments would be mado, A universal inflation would be experienced in everything connected with commercial affairs, and the result would be an explosion, and the long list of evils such an event would produce. There is no measure the government ever perfected which has protected the manufacturer and the agriculturist so much as the Independent Treasury. It has been better for the manufacturer than the highest protective tariff they ever had, and to the agriculturist it has been inva- luable, in preserving a uniformity in the value of the currency, which they have heretofore seldom realised. The demand for a repeal of the Independent Treasury act is loudly called for by the banks, through their organs, and they belleve that it is not only for their interest, but for the interest of the country at large. Now we know that it is net for the interest of the peo- ple or the country, or for the interest of the banks them- elves. These institutions would fiad it more for thei, interest if they would confine themselves solely to a le- gitimate line of business, which the Independent Trea- sury favors more than opposes. They oan keep a mode rate cireulation, receive deposits, and make discounts, as well with the Sub- Treasury without it The only influence that act has upen them, isthe check it has | upon every speculative movement, and the effect it has upon the currency. One of the strongest arguments, therefore, in favor of preserving this act, i the opposi- tion toit from the banks, We havo, in years psst, had enough of an unrestricted banking power; the ope tion of the old United States Bank was a practical illus- tration ofthe operation af enormous banking capital, go- verned by cliques of speculators. The revulsion through which Great Britain has just passed is the result of the speculative operations of the Bank of England, and those eapitalists immediately ocnnected with that institution; and if it was not for the Indepen dent Treasury, we should soon have inthis country a ri_ milar power, governed bye similar class of speculators This 1s what the banks in Wall street want; it is what the banks of the whole country want. They want the management and control of the financial affairs of the country; and every sttempt of the government to regu- late ite own finances, is opposed by these institutions, It is now more than twelve months since the govern- ment separated itself from all banks, and the banks see that their power is rapidly leaving them; that they ar, not of so much importance as in times past, and that the Independent Treasury will soon deprive them of the lit- tle remaining influence they have upon the currency. In view of all these facts, it becomes a matter of much importance in what manner the new loan of the government is negotiated—whether the monay ia raised by an issue of stock, or an issue of Treasury notes of large or of small denominations.
