Mr. Buchanan and the Fifty-t our Forty Men— History of the Oregon Treat y— Reflections thereon —Mr. Buchanan and Mr. Polk still Fifty- Four: Forty Men, You will recollect that I suid in one of my letters published a week ago, that Mr. Buchanan and Mr. Polk are still as much fifty-four forty men as ever. The publication of the official correspond- ence between Mr. Buchanan and Mr. McLane, and between the President and the Senate, am- ‘4 : ply proves the truth of my assertion. Mr. Bu- chanan has been severely censured by the ultra fifty-four-forty men for alleged inconsistency.— Hut the publication of this correspoodence proves by 1 all question, that his sentiments were en- tirely unchanged even up to the last hour of the negotiation, and that the acceptauce of the offer made by Great Britain was reluctantly forced upon hin and upon the President by the action ot (be dent or Mr Be Sena ear tiat neither the Presi- or even Mr M‘Lane, en- lertained any dea that the projet olfered by the British government, would be gravely tr ated as an ultumatam by the Sena: ynrd hat it would be recommended to the Pres deni by three-fourths. that body—87 io 12—without teravon, as the basis of a treaty. When Mr. Buchann first became Secretary of State, or shortly afier, an offer was uvad by the President to settle the Oregou question on the basis of the 49th parallel. This was reje oy the British ingle word of al plenipotenuary. Mr. Pakenbiro, and .* was im- mediately withdrawn. The President in his an- n message in December lest, insisted on our right to the whole territory, and cis was followed up by Mr. Bochanan in is instructions to our minister at London. In his desparely to Mr. Me- Lane, of the 29th of January lust, he says :— “The Presitent will never abandon the position he has taken in his message. Clearly convinced ot the right of the United States to the whole territory in dispute, and relieved, by the refusal of the British government to ac- cept this offer of compromise froin the embarrassment in which the acts of his predecessors had placed him, he would not now authorize the conclusion of a treaty on thai basis. But the , his constitutional isers, are now in session The qnestion of pe bce ofa ir may be involved inthe issue. They are a branch offthe war- making as well as of the treaty-making power. In de- ference to the Senate, under these circumstances, he would, in the first instance, feel it to he his duty to sub- mit such @ proposition for their previous advice * * * "The President will accept nothing less thant the whole territory, unless the Senate should otherwise determine. In varions other communications to Mr. Me- Lane, be puts our title in a clear light, giving it as his own opinion, and that of the President, that our title to the whole ot Oregon is good, and; should be upheld; but at the same time saying that should the Senate advise a compromise, the President would feel constrained to adopt their advic Tn a despatch to Mr. MeLane, dated Feb. 26, 1846, he says: n “The President, since the date of his messege, has seen no cause to change his opinion either in regard to our title to @regon, or to the manner in which itought to be asserted. But the federal constitution has made the Senate, to acertain extent. a co-ordinate branch of the treaty making power. Without their advice and consent, no treaty can be concluded. This power could trusted to wiser or better hands. Besides in their e character they constitute « pertion of the war as in their executive capacity they compose a eae the treaty.making power. They are the repre- sentatives of the sovereign States of this Union, and are regarded as the best index of the opinion of their constit A rejection of the British ultimatum might proba- b to war ; and asa branch of the legislative pow ‘ould be incumbent upon them to authorize th necessary preparations to render this war successful. Under these considerations, the President, in deferenc to the Senate, und to the true theory of the constitutional respons of the different branches of the govern- | ment, will forego his own opinions, sv tar as to submit to that body any proposition which may be made by the tish Govern ot in his judgment wholly incon- sistent with the rights and honor ofthe country. Ner is et to be disguised, that from the speeches and pro: | ceedings in the Senate, it is probuble that u proposition to adjust the Oregon question on the parallel os 49 degrees would receive their favorable consideration.” On the 28th of April, Mr. Buchanan writes again in relation to the above reiteration of the positions assumed in the President’s message : “ Upona caretul review of my despatch to you (Ni ‘0. 23) | ow 96th February last, the President finds nothing to change. It will still continue to be te guide of your conduct.” Now, this disposition on the part of the Senate, to come toa settlement on the parailel of 49, was mnnifest to everybody. Mr. Buchanan and | Mr. Polk knew that should they reject a prop- | osition emanating from the British governinent | to arrange the question on the parallel of 49, they | would not be sustained in so doing by the Senate ot the United States; and notwithstanding ne 8d their sentiments remained unchanged as to the | duty as well as the expediency of adhering to the positions taken in the Presiden:’s message of De- cember last, they nevertheless felt constrained, | situated as they were, to lay the projet of the Bri- | tish Government which formed the basis of the treaty, before the Senate. But what above all fully and conclusively vindicates the President and Mr Buchanan from the charge of inconsis- tency is the declaration contained in the Presi- dents message to the Senate, accompanying the proposition of the British (vovernment. In that message, dated June 10, 1846, the President says: “ My opinions and my action on the Oregon question were fully mace kaowi to Congress in my annual mes- tage of the second of December last ; and the epimons therein expressed remain unchanged.” Now, neither the President nor Mr. Buchanan, as | before remarked, had avy idea that the Senate would accept the proposition without one word of change ; and lest there should Le any doubt in the minds of the Senate concerning the cha- | racter of the proposition, the President accompa- | 4 | itor those who will tay fication ; | Intely insisted upon, ana in | of disturbing the peace of the world. nied the documents with extracts from the de- spatch of Mr. McLane, of May 18, 1846, in which he say: “1 still entertain the opinion, and although from a va- riety of causex—in part, perhaps, from an expectation that in the United States this point (a limit to the period of iree navigation ef the Columbia) may not be abso- art liom deference to inte- rests and impressions at home—tue7 couid wot be induced in the first instance to make an oifer with sucha qi t, if the adius'ment of the questics should be found ‘o J depend upon this point only, ‘uey world yield | the demand tothe permancnt navigution of the river, and be content to accept it for such a number of years as would afford all the substantial advantages to those interests they have particularly in view that could be reason: desired.
