May 13.—The Mayor, ¢¢., vs. Stephen Whitney —This was an action to recover $4810, an assossment imposed on defendant in June, 1837, for building a bulkhead across Pike slip, in continuation of South street Defendant contended that the act of 1818, under which bulkheads are constructed, only impose the expense on such per- sons as owned land behind the bulkhead, and that inas- much as the defendant's lot was not behind the bulkhead in question, but beside it, he could not be charged. The plaintiffs’ counsel insisted to the contrary, and also relied upon a law of 1813, authorizing the Corporation to “fill uP alter and amend reyer9 slips,” and charge two thirds of the expense on the persons benefitted. Judge Ed- monds ruled, that if the preceding statute were made the law applicable to bulkheads, the plaintiffs could not re- cover, because the bulkhead in question was not opposite to his lot ; but if the jury believed that the improvement was made under the statute for filling up the proceedings under it had been regular, find for the plaintiffs. May 13.—The Prisoners on Blackwell's Istand.—The case referred to in the Herald ot Tuesday, in relation to the prisoners on Blackwell's Island, was called up yes- terday morning, and the keeper not being able to make out his return, case was postponed for a day or two. The Nuisance Case.—The People vs. Elder and oth —In this case the defendants were convicted, some time since, of causing a nuisance in the upper part of the city, by erecting an establishment for melting tallow. The parties were called (up, yesterday, to regeive jud; . Mr. Rildaback only having appeared the District At- torney moved that bench warrants be issued against the other defendants, which was granted. The court then adjourned until this morning, when the parties will be brought up. Supreme Court. Before Chief Justice Bronson, Justices Beardsley and Jewett. Mar 13.—The People vs, Costello—In this case, which was tried in February last, inthe Court of Sessions, and the defendants found guilty and sentenced to the Peniten tiery, and are now undergoing their sentence, an applica- tion was made to this court to review the decision of the court below. ‘The following points were made for the prisoners :—First, that the offence charged was not one ‘at common law ; second, that there was no law author- izing the court {o inflict punishment ; third, that the te: timony of a witness, not cross-examined, should hi been struck out. The District Attorney made argument in reply, on behalf of the people.
