Jan. 6.—Marshall Burton and others vs. Heman Norton and John W. It seems that the first named of these defend. ants, and father of the other herein named, carried on the | fleurand commission business in South street, and that he entered into an agreement with his son that he should be employed by him as clerk, and that he should receive, aa asalary, allthe profits on sales made by him person- ally, and hat he should sustain an equal portion’ © of the losses thereby accruin; c- The purchases were all made by Heman Norton, in his own individual name. Between the 18th of October and the 13th of November, 1844, he made a purchase of 355 barrels of flour, in all amounting to $1ee) 12, which, with the aoe of $155 54, increas- ing the total amount to $2,04 is now claimed.
