On the part of the defence, several witnesses were called Li) the previous good character of the ac- cused. colored barber also testified that King, on the day of his arrest, observing a man standing for some time about his door, inquired who he was, and on being informed that he was an officer, stated to witness that he had some property in his possession that had been left by some boys, and which he suspected to be stolen, and asked witness what it was best to do with it; andon witness saying that he did not know, he replied that if he wi ire it had been stelen, he would throw it into the street or take it to the Police Office. Dec. 12.—Feliz Quinn vs. dbel Wheaton.—In Septem- ber, 1844, the complainant, who had found tnat twelve of his hoge had beoa driven to the public pound, end which had been running at large in the thoroughfares of onr city, contrary and in violation of our laws, made a demand for their restoration, tendering the sum of nearly twenty dollars for their redemption. ‘This tender was declined as insufficient, and a bill of $37 50 was present- ed, as being the amount to which the city was entitled as penalty, cost of feeding, and the amount paid to the party driving them to the pound. Mr. Granam, for the defendant, moved @ non-suit, ey upon the ground that it was a mero question jaw, and partly that a suit of this nature would be quite unentertaining to the jury, and one calculated to wea the patience of the Court.
