After the close of our report last evening, in the con- tinuation of the examination of Mr. Ayres, of the Bank of America, a transcript which he had taken of a portion of the records of the Bank was ruled out as inadmissuble, not being certified to by any legal authority. Another point, as to the admissibility of witnesses’ testimony ap- pertaining to deposites and drafts of the accused, other than the $750 of resent indictment, was debated be- fore the court up to near 5 o'clock, when the court was adjourned. As the first witness this morning, led.—I am inthe Treasury Depart- here since 1 37; my duties relate to and diplomatic ‘expens e government ; kept on file in the Treasury certain papers handed by the counsel for the prosecution to witn who approved them as the original requisitions of Clerk of the House of Representatives upon the Trea- sury. The prosecutor proceeded to read the firstof these ers, but was desired by the counsel to shew it the accused, which he did, and then read the paper, dated 27th Dec. 1843, addressed to the Secretary of the treasury, calling for the sum of $15,000 in favor of C. Cashier of the Patriotic B: then another ing for $20,000, dated Fel March, for $30,000 ember, 20th October, and 2d December, uccessively. Then ‘ollowed an order in favor of C. Bestor for $15,898 29, xe. Witness thought it most proper to state appropria- tions for the fiscal year, beginning July, 1843, and the contingent funds of the Heuse drawn and deposited during said fiscal year. At the beginning of the ‘iseal year, 1843, there was a balance inthe Treasury redited to the contingent fund of the House, of $219 40. 'y an act of March 3d, 1843, $175,000 were spprepriated to the House contingent fund. On the 6th of January, 1844, Mr. M. St. Clair Clarke, late Clerk, made are-pay- mnent in favor of contingent fund of the House of $5,000. On Sept. 8, 1844, by a warrant from the Clerk, $10,000 were paid out from the Treasury to Mr. Clarke, and ona like warrant of Sept. 29th, following, $16,000 more were drawn from the contingent fund in the Treasury. Wit- sess was requested to state the items of the $230,388 29, w 0 the account of the contingent fund of the House in Dec. 1844. At the beginning of the fiscal year 1844, there was a balance in the Treasury to the account of he contingent fund of the House of $20,219 40 On the 17th June, 1844, $75,000 were Cy ae to the contin- gentfund’ On'August 5, 1644, Mr. J.
