J. 1 le Nuwiy—Naval Court Mutual and Captain vorvhees— More Distingwish- ed Visitors at Coleman’s— The President’s Health— Mr. Sengstack’s Letter and the U.S. Journal. 1n the case of C. J. MeNulty, indicted before the — | Criminal Court for embezzlementof public moneys | entrusted to his charge, the argument was closed | this morning between Mr.-Fendull for the indict- | ments, and Mr. Hoban for the accused, before the | Circuit Court. Mr. Hoban pleaded the vagueness of the specifications in the indictments as the reason | why they should be quashed, and dwelt largely upon the case of Tobias Watkins, in which the first in- dictment was overruled, because of the inexplicitness ofthe charge. He insisted that the crime of which his elient stood accused, as in all other cases, should be distinctly, fully, and minutely specified ; that the indicted party might know the fan of assault and his means of defence. But in these indictments, | neither the alleged embezzlements, nor the time of their oce: nee, nor the agencies employed, nor the character or sum of the moneys alleged to be fraudulently and felontously squandered by the ne- cused, were specitied. In ull these particulars the | indictments were vague and inexplicit. | The argument of Mr. Hoban appeared almost to | shake the Judges who are to decide upon this de- murrer—whether the indictments are sufficient, or | should be set aside. We know not how the accused | is to be brought to the test of the law, and the penal- | 1y of justice, unless through general specifications, sufficient to cover the facts of his embe: zlements. | If it shall obtain in this ease, that the minutia claim- ed as atial to a lawful indictment by Mr. Hoban, ble, then MeNulty is a free man, and beyond the reach of the law. It is impossible to ney» squandered under his care, or the times at which he appropriated them, or the agencies em- | ployed, or the particular character, whether paper or | coin, or both, or either. [tis sufficient for his ar- | raignment, sufficient for his accountubility, that | there is a deficit of some $33,000 of the public mo- at8 | neys entrusted to his charge as a public officer, of which he has made no return; and which, thus far, °| are a lossto the treasury, and a breach of his trust. | There will be no safety for the public treasure if a | defanlter may not be tried because the exact parti- culars, details and circumstances of the offence can- | not be reached. Swartwouting will at once become the order of the day, and the venal provisions of the Sub-Treasury act will be a dead letter—a nullity— We rely upon the good sense of the Court. We | trust that the indictments presented will be affirmed, and that the late Clerk of the House will be prompt- ly called up to account for the violation of his oath, | the betrayment Of his: (Hiends, the. sucrifica ob his honor, and the whereabouts of the aforesaid thirty three thousand dollars We expect a decision from the Court to-morrow. If the indictments be affirmed, McNulty will, be speedily brought to answer before the Criminal Court; if set aside, new indictments will have to be drawn up, which would probably lead to an indefi- nite postponement of the case. Whether the accus- ed bet the money upon the elections—squandered it away at New York and the Springs, or lost it in loans to faithless individuals, copartnerships or cor- porations, or whether it is so invested as to gueran- tee an assurance of the safety of the fund, let us know. The President of the United States, we were glad to learn, on inquiry to-day, was recovering, und soon expected to be as strong as ever. We are told that Mr. Sengstack, one of the ring- | leaders of the local democracy of Washington, is pushing vigorously for the place of old Major Dade, as superintendent of the district penitentiary. Re- cently he published a letter in the U. 8. Journal, in which he argued to show that he had not heretofore made any money from painting the White House, although he had been paid some $14,000. The let- ter was printed us written, and abounded in un- tical blunders. Some of the particular ends of Sengstack took this letter as printed to Ca;tain Polk, and wanted to know if he could pa- tronise such a dull scholar as the ‘* House and Sign Painter” had shown himself to be in this didactic composition? Sengstack heard of the movement, and down he goes to Messrs. Fisk and Dow for re- dress. The very same evening Fisk and Dow state that the blunders in the letter of Sengstack, were not his, but their’s. However, it is not necessary that the overseer of the penitentiary should be a grammarian, Wasuineton, June 13, 1845. Coleman's dEolian Attachment, and the Old Tars of the Navy—A Scene at Coleman's Hotel. Our petition has been heard. Our faith, certainly larger than a grain of mustard seed, has effected this great result. We hada most revivifying shower on yesterday (Thursday) afternoon, and the day closed with a bow of promise, like a wreath of light on the bosom of love, overarching the sky. We were witness at the Naval Courtmartial on the same day, to an incident which has been mentioned by the U. §. Journa!—the main charm, however, omitted in the notice. While the Board were listen- ing to the testimony of one of the witnesses, a tra- velling gentleman and two ladies, just arrived, were » to the Court Room, the doors all open to catch the little air in circulation. The gertleinan took his seat at the piano, and, by request, commenced playing a beauti tul air. But, though well executed, the eharm was not in the execution, but in the celestial, harmonious accompaniment of the AZolian attachment—the beautiful invention of the lamented Coleman —a worthy namesake of the host of the house— in which the scene transpired. The hardy old vete- rans of the navy were moved—they had heard no syren music like this—they had heard no echoes trom the coral cliffs of the Southern Ocean, in the breezy twilight of their gloomy skies, to approach it. Those glorious old tars had been all round the world, but music like this, of the ®olian piano, they had never heard before. They paused—they pricked up their ears, as if the watch’ had called out a strange sail in the offing. They paused—several arose—but soon they resumed their duties at the board, with an expression of countenance, softened and benign, as if a beautifal woman had passed through the room, and smiled and bowed to every one of the company. The inventor of the ‘Zolian attachment, after its successful application, was as- suredly prepared for the still more melodious and mellitious harmonies of Heaven. Ww. D. C., June 13, 1848 aptain Voorhees. ‘The Court met this morning at half-past 10 o'clock the Journal of yesterday was road and corrected. Lieut. Brookr was called—The question to him: “Did you hear the Captain of the Republicano say to one of the American seamen, before he left the Congress, that his time was ont, and that he wished he (the Captain) had the money to pay him off,” was objected to by the Judge ‘Advocate, onthe ground of its being learned through a third party, and came to the knowledge of the accused, after the taking of the squadron. The Counsel for the accused maintained that the question was perfectly legal, and the answer of Lieut. Brooke entitled to be admitted as evidence. The Court was cleared, and on the re-open- ing, the Judge Advocate gave the decision of the Court. Several members immediately cried out, “ No! no!” which caused the Court to be cleared a second time. After reassembling, it was announced that the question was admitted. The Witwess then proceeded to relate as follows :—I was on the half deck of the Congress; Capt. Craig of the Republicano came out of the cabin of the Congress; he poke to a man whose name, I think, was Potts, (one of the men brought on board of the Congress from one of the vessels of the Argentine Squadron;) Captain Craig said to Potts, that he, the Captain, had applied for his, Potts’, discharge; that if he had received it and money to have paid him off, that he would have been dis- nof Roses, Azstias, Camellias, Pelorg: ms Rhododendrons, &c., embracing all the novelties of the # Stove and Greenhouse Plats Strawberries, Raspberries and Grape Ving 1 ing Shrubs, Herbas as, ‘id. er fairs are invited to visit | Ath of July excepte 6 4 large collection of Gerenfare aow in bloom, they three to four Sol} TO CAPITALI ICE—To invest ac ble way, by erecti ip for the Emanu-El n oft ing two lots, between Bowery and Kast River, and betwees ne and Madison streets partioulars enqnire at Mr, J or at Mesate, Steuhelmer & Brothers, 07 (he Carden Sundays an will be sold very low, for that ynrpose. charged when his time expired; he also spoke of the faithfulness of Potts’ services on board; and Potts said | the Captain had always used him well, but that he had wished to return to America among his friends, when his time was up.
