[Correspondence of the Herald.] Taunrry River, Texas, Feb. 2, 1845 130 miles from Czalveston. Value and Resources of Texas. Mr. Eprror— As your paper is the only New York paper that reaches this country, I take the liberty to write you a few lines. Iam here situated on what is called ‘the Lower Cohouca Bluff.” We are all in confusion here at thistime, in a political way, as we have expected to have been a part of the United States; but Duff Green came to this coun- try, kicked up such a fuss among the leading poli- ticians and some of the Camanches, that every thing now is in doubt whether we wili be annexed ornot. But we have large and fine cropsthis year, and we will show you folks in the Statesin a very few years, that we will be the greatest cotton coun- try on the face of the earth. There aye quite a number of sugar planters who have commenced operations just below us here, who are doing well. We have a large earavan train of imigration daily passing on to the west- ward part of Texas. lur population is increasing faster at this time than was ever known before. Two-thirds of the population of this country are in favor of abolishing slavery forthwith—and let what will occur, there will remain but a small por- tion of this country in slave One half of the emigration from the Slaveho! iding States came here to get rid of slavery. We have a large Ger- man emigration some distance above us, who are opening large plantations, and have discovered a coal mine within their lands, and are holding out inducements to their relations in Germany to emi- grate, and Ihave no aoubt, we shall be the most thickly perolated new country in the southwest in a very short time The first bale of cotton that was ever carried down this river, was in 1838, on board the steam- boat Trinity, the first steam ‘packet that ever ran on this river, and which was brought here by a New Yorker, by the name of John F. Cowan, who isthe present owner of a very large ‘tract of Jand, which willbe very valuable some day. Mr. Cowan left this country in 1840—he so! id the Indians goods—they became very much attached te him— 80 much so, that if a New Yorker comes here now, they ask ‘*if they know him;” and if so, itis a pertect passport—a coi maplete ‘protection—for the: are lasting in their friendships. Should we be a mitted under the protection of the United States, so that we could be neighbors to our fathers and mothers, brothers and sistere, we would almost feel, as though we were on our native soil. Marine Courts’ Jurisdiction—Suits against Corporations —It has been decided by the Merine Court, that that eourt has jurisdiction in suits against corporations to the amount of $100. The following is the opinion of Justice Smith, to whom the application paaient ee as made Ithas been w tablished by the Court of Errors, thut the Marine Court is 9 court of record, and such be ing the case, corporations can be sued as well in this court as any other court of record. But laying out of the question the fact that this is a court of record, and treating it only as @ peculiar Justice’s Court, unregulated by the rules go g courts of reeord, fhave no: a doubt of tho right of this court to entertain suits agai Tpc- By the provisions of the act creating the Marine yer among other things, that this Court jurisdiction to hear, try, and determine, all lebt, dpe i tooladion: fepvaben trespass and trespass, inc! trespass on land estate,” &c., &c.; “and for the actions on on the case, or other real of hearing, trying, and determining, all such actions as urpose are hereby made cognizable re the same court, such court is hereby vested with a!l such power or authority is vested in other courts of record of this State.” Vide section 105. Here isno limitation confining the jurisdic tien to actions it natural persons, but the langu language is as to “all actions,” without any limitation as to t class of persons. In'the same section, in the limitations poiated out, this. court is prohibited from entertaining suits “wherein the people of this State are concerned, o “against any executor or administrator,” together with other limitations particularly specified ; but there is no prohibition as to actions against corporations. If corporations were meant to be exempt, ewe does not the act so exempt them, as well as ‘the people of the State,” and “executors end Taciatetatvinors,* and others, from being sued in this Court. (By a subse- quent act ‘passed April 12th, 1822, the Prohibition as to Srecutors end administrators ‘was removed) The Legisla- ture, in defining the jurisdiction of Courts held by Jus- tices of the Peace, among others makes the following pro- hibitions as to jarisdiction—“ Nor of actions agvinst exe- , or administrators as yainst Corpora- ns.” R.S, part 34, ch. 2, title sec. 5, “Actions cognizable be.o1 brought by and agauust a all in their own right, y article 13 ter, sec. 1, the provisions at this title are made not to ply to Courts held in the city of New York. There no doubt by the word “ persons,” as used abeve, the Le- gislature meant 2 other then artificial persons or me chap- Covporetions. It is contended that there is no express provision in the statute creating this Court, ing at ju- risdiction in actions against Corporations, and therefore it cannot maintain them. To this may be answered :—Ist- The clause sing jurisdiction in “ all actions” ot the na ture there spe ives it necessarily in actions at Corporetions, but if it does not, it 5 not recess 'y should, and as the Legislature defines in what cases this Court shall not have jurisdiction, and suits against Cor. porations not being prohibited, it follows they were not meant tobe. 2d. there is not! hing in this stainte autbo- rizing Corporations to bring suits in this Court, yet it has been decided the; ve the right so todo. 7th John, R. p. 366, Hotchkiss vs. the Religious Society in Homer. 3d. In the statute organizing the Superior Court, nothing can be found which gives it jurisdiction in express terms in suits against Corporations, yct no one doubts the ju. risdiction of that Court in this respect. There is nowhere to be found any statutory provision in relation to what courts shall juriediction in actions st corporations, excepting the ‘ibition before eetensi & to Courts Dae ey Susticer of the Peace, and ‘he following, among the general powers, privileges and abilities of corporations”— srt eh sie 602) viz + sue and be sued, complain an defend in any court ‘of Ia or equity.” Finding nothing then in the statutes inter’ tering, we are led to resort to the decisions on this sab ve The enly two | find are the cases of the Minister, ‘ke. of the Datch Church, &c ve. Adams in 6th John. R and Hotchkiss vs. the Religious Society in Homer, in 7th John R. p. 846-7. Both of these cases apply to Justices’ bana bat do not touch the Marine fart as I shall igued show. Inthe case in 5th J. R., the reason as- oy Justices’ Courts cannot entertain ju jurisdiction ‘ainst corporations is that both the form of the first pro- oe dof the execution, preciude the court from exer- cising jurisdiction, the form of each being prescribed by statute, and being such as cannot issue against corpora . The for being by summons, and the be “s ing gsi te ots sad ttels and the body, Sic. nul. ‘of suing corporations when that Cae cision was meter und to issue, Hooret the act organizing the Marine Court, the execa tion is directed to he against the goods and chattels of the defendant, or against bis body, just as it is in every other cou:t of record in this State, A'ter citing further authorities in support of Hir Honor’s views on the subject, the Justice concluded, the the court held there was jurisdiction to sue for the amount of $100 in corporation suits.
