Important Movement Relative to Texas im the Howes of Representatives—Benton’s bill headed off —The Chinese Treaty—Consul to Marseilles. J. G. Benyerr, Erq:— Thave reason to believe that a movement will be made in the House of Representatives this morn- ing at the opening ot the day’s session, relative to the annexation ot Texas. The principles involved in the Treaty will form the basis, and it is possible that Charles J. Ingersoll, of Philadelphia, will be the medium through which the movement will be commenced ; ashe is a northern man with true American annexation views. This will have a tendency to “head off? Thomas H. Benton, and hold him in his present position un- ul he is instructed by the Legislature of Miesouri, as he has already been by a large ma- jority of the people of the United States, exclud- ing the abolitionists. The treaty with China contains but little more of interest than has been previously noticed in the Herald, although it 1s one quite favorable to our trade with chat empire. The “biographer ot President Tyler” has been nominated to the Senate as Consul to Marseilles in place of Mr. Croxall the present incumbent, re- moved. Wasuinoton, Dec. 11, 1844. Application to Supreme Court to Release Governor Dorr—Nominations from New York City. J. G. Bennett, Esq :-— Isend you below an exclusive repert of the mo- tiop made to-day by F. C. Treadwell, Eeq , in the Supreme Court, for a writ of habeas corpus to bring the body of Governor Dorr to this city for discharge from confinement. It will be read with interest by your readers, and most especially by the legal profession. Mr. Treapwe.L, who was admitted last week in this Court, presented his application by moving, in behalf of Governor Dorr, that a writ of habeas corpus isue forthwith to bring Governor Dorr to Washington, and give him an opportunity to sign a petition for a writ of error in his own behalf, and to prosecute the same, to the end that the whole record of the Supreme Court of the State of Rhode Island in said case may be certified in due form of law to the Supreme Court of the United States, and the errors (herein be corrected. The facts in this case, as briefly stated, ure— First.—That said Thomas W_ Dorr was indicted for treason against the State of Rhede Island afore- said, at Newport, at the term ot the Supreme Court of Rhode Island, hotden on the fourth Monday of August, 1842, and tried ia pursuance of said ine dictment, and a verdict of guilty having been ren- dered by the jury in the case, was, on the 25h day of June, 1844, sentenced to ** Be imprisoned in the State’s Prison at Providence, in the county of Pro- vidence, tor the term of his natural life, and there kept at hard labor in separate confinement.” Second.—That a suspension of the sentence for one day was allowed by the Supreme Court of Rhode Island, for the purpose of preparing a bill of. exceptions, ‘with a view to maine out a writ of error to the Supreme Court of the United States,” and a bill of exceptions was then prepared. Third.—That the Court refused to suspend the execution of the sentence, and to await the de- cision of the case by the Supreme Court of the United States upon a writ of error, although noti- fied that the imprisonment of the defendant would disable him from proeecntae this defence. Fourth.—That the Inspectors of the States Prison utterly refused to let said Thomas W. Dorr, sign or see a petition for a writ of error as aforesaid. That the Governor of the State of Rhode Island refuses, aud, as he alleges, for want of pow- er, to let said Dorr sign or see such a petition. Sixth.—That sundry citizens of Providence afore- said have signed a petition to this honorable Court for a writ of error, or tor a writ of habeas corpus, which petition is now presented with this motion. The points relied upon fora revisal of this sen- tence were over-ruled by the Supreme Court of Rhode Island, and are— First. —That the act of the State of Rhode Island for defining and punishing treason is repugnant to the constitution and laws of the Umted States, and that the crime of treason cannot be committed against a separate State, but against the United States, and Mr. T. cites Burke’s report, page 1046, to sustain this point. Second —That Mr. Dorr was Governor of the State, duly elected, under the people’s constitution —a republican constitution and form of govern- ment, which facts wiil be presented. Third.—That the whole record shows that if Governor Dorr levied war at all it was against the United States, and cannot be inquired of by any State Court. AEE ‘he authorities relied upon as ving jurisdiction of this case tothe Supreme Court of the United States were quoted by Mr. T., as follows: _ First.—The third article of the Constitution of the United States which vests this power in the court. Second.—The 25th section of the taeregane act of 1789, which prescribes the mode of its exercise by writ of error. I Also, That the writ of habeas corpus is a writ of right, the privilege of which, under the Consti- tution of the United States cannot be suspended, but in the two contingencies mentioned in second clause of the 9:h section of article let. That the necessity for the writof habeas corpus in this case, arises, because the Supreme Court of the State of, Rhode Ieland and the inapectora_ of the State prison at Providence, have thrown im- pediments in the way of the exercise of the con- stitutional right of Governor Dorr to have his de- fence examined by that tribuaal, whose province itis to construe the constitution and laws of the ‘pion. ‘The motion was submitted and the argument will probably be opened on Friday. There is tea- son to believe that the motion will be granted. The nomination of Governor Van Ness, Collec- tor of your port, will be confirmed this week. That ot Henry C. Atwood, for Surveyor, will be sent in to-morrow. He has presented a memorial in hie favor signed by several hundred of the most exten- sive shipping and importing merchants of your city, which will tend much to aid his confirma- tion. But since I have been here, my position has been such, that i do know a thing or two; and perhaps have a chance for obtaining a thorough knowledge of certain events to take place, and that too from a source near the fountain head. The different cliques have begun to ‘post stakes” and to “mark bounds.” Rival factions are watching each other with argus eyes. Every movement is marked, every word weighed. Each class posts their sentinel upon the wall, to make known every movement, to report every spec of news,and to see the latest intelligence. Already is the ‘worn button hole” to be seen upon the coat of certain leaders, who are beset for information as to the best plan for me to set my stake. The current has already began to set, al- beit there are not a few counter and under cur- rents to be seen and felt in some quarters. Parties are drawing new lines every hour, and new deve- lopments made every day, that carry terror to the hearts of some other faction.
