Longworth, reported in the Herald of yesterday, the fence wars postponed until Tuesday next: ¢ Omnibus Nuisance—Patrick Newman, vs. James Mur- phy.—This was an action on the case, to recover a com- pensation in damages for injuries sustained by the carcle driving of one of the defendant's employees. It appeared hat some few weeks since, the defendant was riding on he rear of an omnibus, as it passed the Bowling Green, and that one of Murphy's “ omni? was coming up behind, and that the driver culied to the plaintiff either to get off or take care of himself. The plaintiff did her, and the pole of the defendant’s “omni” strack hin and, as the plaintiff alleges, initicted a severe injury. For the defence, it was set up that the “omni” of Mur. phy was not going over five miles an hour; that the plain- tit! was not so much hurt as he pretended tobe, but that the wound was an old one, and did not need a doc- tur nor employ one, The case went to the Jury, under the charge of the Court, and after the Jury had retired, they came back, and in answer to the question, had th reed upon a verdict? replied that it would depend on the amount of costa which a verdict of fifty dollars would carry. His Honor said that although it was proper for the Court to charge on that subject belore the Jury retired, yet he had scruples as to the propriety of doing it, if the Jury had agreed. ‘The Foreman stated that they had not agreed, and then his Honor said that fifty dollars uld not carry all th costs; and thereupon the Jury immediately said that they had agreed, and the verdict was for the plaintifi—dam: five dollars. ‘The Circuit Court was occupied with the trial of an is sue from the Court of Chancery, in relation to a — ship, which was not sufficiently advanced to enable us to report it.
