The City Fire Insurence Com er ~This was an action on a policy of insurance effected by the plaintiff for $2,500 on a stock of dry woods, groceries, &c., in his store ut Middletown, N. J. store Was burnt inthe month of September, 1643, “ahewall the whole concern was destroyed, the stock in trade, far- niture, fixtures, and busiding, leaving not a wreek be- hind. On the part of the plaintiff, several witnesses were exa- rnined, who proved that they had enjoyed opportunities of observing the nature and quantity of plaintiff stock, and that it averaged trom $2,400 to $3, The defences set up that the proof of the destruction of that amount of goods was insufficient to sustain the action, there being no Witness who could testify ‘pany stock whatever in the store at the time of the fire. No testimony was « duced for the detence. Hix Honor told the Jury that in the absence of any teste mony on the part of the defendants. they would not be warranted in inferring that the goods were not on th mises, ov that it Was an unfair fine. The plaintit shown by several witnesses that it was his habit to have about that amount of goods, and if the defendants sup posed that the stock had been removed before the fire, was for them to have shown it.
