The lidel charges him with being a “ thiet,” o “traitor to his country,” ond thet he had been publicly whipped in New Jersey for stealing poultry. ‘That he had been nine times in prison after sentence, and twelve al Dahoee? his felonies had been compounded without a trial, &e. An additional panel of ten jurors were summoned by deputy Sheriff Arnold, from which, with the old panel, eight only were selected, as the remainder were set aside, ving expressed an opinion either unfavorable or tavor- able to the accused. The Court then took a recess until six o’clock, in order to give the jury time to deliberate. At six o'clock they assembled, and the jury were call- ed into Court. The foreman stating thet they were un- able to agree, and that they would in all probability con- tinue so, the Court ordered them to be discharged. The jury refused to tell the position in which they stood as to acquittal or conviction.
