Grenzebach; she died, leaving several children by her husband. Barbara, one of the testator’s own laughter died shortly after her father’s death, unmarried and wit! out issue. Mrs. Grenzebach’s children claim to be en- titled under the will of the testator to one-fith 0: Barbara’s one sixth of the testator’s property. The children of Mrs Grenzebach brought an eject- meut to recover the one-sixth of Borbara’s one-fifth, claim ing to be entitled thereto under the above clause in the testator’s will. A special verdict was rendered by con- sent, and judgment given for the defendants inerror. A writ of error was brought, upon which the present pro- ceedings are founded. Beach and John Tracy — This was an action ol trespass on the case to recover damages for the illegal taking of certain pro- perty, alleged to betaken by the defendants, which had been previously mortgaged to defendants. ‘The tacts were shorty these. A person ofthe name of Martin Moran, was indebted to piaintiff inthe sum of $444, and in order to secure the plaintiff in the payment of d, on the Sist March last, execute a mortgage icles of metal and tinware. Previous to the execution of the mortgage, the defendant,Beach, obtained a judgment in one of the Ward Courts, against Moran for $60 or thereabouts; upon which he caused to be issued an execution, and putitinto the hands of Tracy, the officer, defendant, who leviei on the property mortgaged, aud had it sold for the satisfaction of his judgment. The defence was that the mort.age was fraudulent, and executed without consideration, for the purpose of covering Moran’s property from his creditors. It w also alleged tor the defence that the property was left possession of Moran, aud thathe traded on it rebut the defence, it was alleged that Beach had been paid the amount of his claim, ot the greater part of it, and wa: also alleged by his counsel that the judgment was im- properly obtained, iaasmuch as the said Beach had con- trived to keep Moran’s principal witness out of the way. After counsel on both sides had summed up, his Honor told the Jury the question was, was their evidence to convici Beach with the seizure and taking of the goods, he being plaintiff in the original execution would not make nim responsible. Cuantay, a farrier, who was for- meriy in the employ of Charles J, Taylor, furrier, of 174 Water street, was tried on an indictment for burglary in the third degree, and grend larceny, in entering the store of Mr. ‘Taylor onthe 7th of March 1 and preeilog tas caps, furs, skins, and ribands valued at about $1000. The accused was tried on the count of the indictment charging the grand larceny, that ofthe burglary ha been walved for want of evidence to sustainit. Mr Tay Jor testified that Chartry had been in his employ, and that he was led to suspect him in the first place a8 guilty of the offence, after a man named Anthonv J. Hirsch had been arrested, and a portion ot the stolen goods recevered. The testimony of Henry Fay, of Baltimore, was read to the Jury, in which he testified that he purchased aquan- tity of seal skins, nutria skins, pirces of ribands, &=., from the accused, who represented himself as Mr Henry Mitchell, These skins and ribands were delivered to of- ficer Bell, of Baltimore, and were identified by Mr. Taylor as ide of the goods stolen. The defence, conducted by Wm. Shaler and Wm. M. Fiice, Exqrs., offered no evi- dunce, but contended that 0 the evidence of the pros tion, the accused could not be convicted of burglary, as it hed not been proved, nor of grand larceny, as there was no specia! count in the indictment under which he was tried distinctly charging the grand larceny as sepa- rate from the burglary, ‘The Reconper charged that although the burglary had not been proved, the jury could under the evidence before them, if they thought it sufficient, find the accused guilty of grand larceny under the second couat of the in- dictment, which verdict was rendered, and the prisoner then remanded ‘or trial on another charge of grand lar- ceny The counsel for deience took exceptions to the charge. Aubery, No. 13 Park Row, onthe 18th of February last. The prosecution proved’ by Charles koss, of Anthony street, that the accused gave him ad uble barrelled pistol to pawn the morning ater the property is said to have been stolen, Which pistol was identified as the one taken from the hotel of Mr. Aubery. The accused was de- fended by Enoch E. Camp, who contended that under the evidence the accused could be convicted of petit larceny only, ht but the pi traced to his posses: elas aoe c ‘The Court so charged the jury, and after a they returned a verdict o1 guilty of petit larceny only, and the Court sentenced him to the penitentiary for six months. ‘The Gran Juny came into Court, returned a number of bills of indi tment, aud retired for the transaction of further business. Gronox Oxiver, alias Haliday, alias Roberts, was tried on an indictment of burglary in the third degree, in en- tering the tailoring store of John Major, 232 Canal street on the I8thof January last, and stealing a quantity of ready made clotbin, Char! Nichols, who had also been indicted for the same off ace, was calied as a wit ness by the progecution, @ nolleprosequi having been en- tered in the suit ogainst him, and testified that the accu sed was pot p.esent atthe burglary, but that it wascom- mitted by himeel!, Gibbs alias ‘I ibbin, Ned Holes, end Fay. There being no evidence against the accused except the fact of his having a portion of the stolen goods in his pos- session which Nicholls stated was given to him atter the burglary. The object of this sketch left home at an early age—net content with the tranquil enjoyment and ease of competency in rural lite—came to Phila- delphia and entered that of a busy, bold, and enter- rising merchant. He commenced on a small scale, but by his industry, integrity, economy, and atten- tion to business, he rose rapidly—Dame Fortune smiled—he, in common parlance, became ashipping merchant —he visited Europe to superintend a branch of the house with which he was connected, and soon alter, having the confidence of the mer chants of our country, was appointed American con- sul at Antwerp, where he laid the foundation of his great fortune He shortly after retired from mercantile pursuits, having applied himself so closely as to impair his health—then made the tour of Europe, and returned to his native country with his health but litte recruited; he placed himself under the care of two of our most experi enced physicians, visited by their directions the Virginia Springs and other watering places to no purpose, he then settled himself in our city, entered extensively into the improvement of it and the city of Camden on the opposite side of the river Dele- ware, and in proportion as he improved them, did his fortune and health increase, and from being the owner in early life of a single farm he acquired possessions and wealth, the extent of which has perhaps never but once been equalled in Pennsyl- vania, and in all human probaty!ity never wii be, by any one man again. He was judiciously benevolent; ever found ready te encourage the man of limited means, and send him on the road to fortune—this was particu- larly manifested in his directorship of the Bank of Pennsylvania, in which he was a large stockhold- er, always refusing discounts and accommodations to the rich and extensive operators or speculators, prefering the humbler mechanics, tradesmen and merchants; his conduct in that particular may serve as an index to his business intercourse with the world. Indeed for the last few years of his life he had little other than business intercourse His time was occupied in the employment and payment of a vast number of the humbler portion of our citizens, to whom and the city of Philadelphia generally his loss will long be felt, and many a were tenants of his, will Jive to mourn his loss, who knew and feit for them in a way not to be misunder- | stood Mr. Ridgway left a son and two deughters, to whom, in equal proportions, after providing in a | him in business, he bequeathed his vast fortune. In this last act of self a true man, his children were entitled to the products of his enterprise—they have received it without stint, limit or condition, and cither of them may be considered as wealthy as any citizen of our State. Theson of Mr. Ridgway isa true American nobleman—so plain, unassuming and atid on in his manners and deportment, that he might we be mistaken for a geatleman of humble fortune.
