The Herald—Trial of Godfrey Pope, and his Ac- quittal—A Scene in the Court Room—C ‘ongres: sional Campaign commenced—Busincss, §¢ Dear Benner :— As you have had no advices from this place for some time, and having every reason to believe the vr of the letters signed Hawkeye, has left the 'y, we (my cousin and myselt) propose to enlist under the banner of the Herald, and give you regu- lar and accurate advices, of the way “things are done up,” in the “ Falls City.” Of the notoriety given to your paper by the correspondence from this place, and the excitement that prevails, when it is known that a letter has appeared, you can have no idea. Allthe old maids, bachelors, young lasses, and beaux fly to the several news offices, some on erutches, some on horseback, some on foot, &¢. to geta Herald ; and when it so happens (as it often does.) that these news offices have not been fur- nished with a gifficient number of copies to supply every body and his cousin; then your subseribers have either to put their papers under lock and key, or be bothered to death by these old grannies, with the continual application of“ Mister, will you lend me your Heralda tew minutes 7” Thisthing is out of the question. Can’t you read them a lecture on the subject. f The trial of Godfrey Pope, charged with the mur- der of L. Bliss, ir. commenced on the 13th ‘and con- cluded on the 15th instant, which resulted in the ac- quittal of Pope. A great many witnesses were ex- amined on both sides, and it was proven positively, that Pope hunted Bliss out, took his hand, drew a pistol and shot him down ; but still, the jury, after retiring about thirty minutes, rendered a verdict of “Not Guilty.” We have heard it said that P.’s father isa man of considerable weuli. Consider- able excitement prevailed during the trial, and when the verdict was rendered a general hiss was raised, to the great displeasure of the friends of the accu- sed, and the aunoyance of the Judge. * Ascene took place during this trial, which we deem not unworthy of relation ; it is as follows— The weather being rather warm, and the Court room very much crowded, made it unpleasant for a man, when he had once gotten in the room, to stay ir, and difficult to get out again, even if he was suffo- cating with heat. In this situation was placed a rather portly gentleman. Well, Jesse had been try- ing for some time to his own discomfiture, and the disturbance of the Court, to vet out of this crowd ; Thomas Farnham. There mre several others that may be classed as ‘ Peter Funk” establishments. Several heavy credit sales have already taken place, which have been well attended. The bids were spirited and the goods knocked down at tair prices. One of the firm of Messrs. F & P. is now in your city, making extensive arrangements forthe present season, and from the well known reputetion of this establishment tor promptness aud general business facilines, | have no hesiraney in saying that all kinds © merehanise entrusted to them, by New York merehante, will be well disposed of, and the eeds promptly remitted or paid over. The principal hotels of the city, to wit: the Ame- rican, Western and Mansion House, are beginning to fill up with strangers. The Washington Ho- tel, recently opened by Mesers. Thomas & Goodwin near the American, is large and commodious. The proprietors are well anc favorably known here, their house will no doubt merit and receive a’ libe- ral support from our citizens and the travelling com- munity. It is pleasantly located, and any number ot boarders may be comfortably accommodated at reasonable prices. The facilities for tourists and travellers are now so advantageous, that an unusual number of strangers ure expected to visit the mighty cataract of Niagara during the seasen. At thes fashionable and delightiul: summer resort, you can safely recommend your triends to stop atthe “Cata- ract,” an excellent house kept by Messrs) Whitne & Sons. On the opposite side isthe “Chica House which I 4elieve is to be under the suj rvision of Mr Griffin, formerly of the “Eagle.” Thx gentie- man is too favorably knewn to visitors to require a word of praise — [tis enough to say, that those who stop at his house will be well “done for.” Some weeks since a runer was prevalent here that Dr. Hadduck had been removed from the Post Office, and that Geo. W Clinton, Eeq. had been ap- pointed as his successor. Jt turned out, as L antici- pated it would, all “bosh !* So that the Doctor will probably hold on to his office as long as Captain Ty- lerstands atthe he min Washington. The editor of the Commercial is very hostile towards Dr. H Cause why? he occupies the very station that he himself anticipated filling Previous to the »ppoint- ment, | was very much opposed to both the Doctors, bur the atfiirs of the office have been so well ma- naged under Dr, H. that I think it will be best. to have him remain in office. Every thing pertaining to ite duties has been done in a systematic manner, the grumblings of the Commercial to the contrary notwithstanding. Nothing new in reference to political changes has transpired hereof late. Little is said touching vext Presidential election, though it is gene? 1 by the knowing ones that the dein: whoever he may be, will succe¢ ed to believe |)01 Mr. Van Buren y be sndidate, jnchn nan but only succeeded in getting pushed and shove The reli rcieties here ear to be flou- about until he found himselt standing in the lobby, ] rishing eir ances, as great numbers have been right between the bar and the bench, which caused | converted ring the winter and spring, who ere the following dialogue and confusion :— Jupge—“ [wish you would get out of there, sir; what are you doing in there, any how, sir; go out sir.” new, toa! opearances, zealous and devoted chris- tians. Many new pieces wiil be preduced in the course ot the summer, and several of the principal stars of the country are to appear, which, with new scenery, decorations, &c_will add much to the popularity of the house. ‘To-day the water is to be let into the canal, and Buflaio will again be bustle ant prosperiy. Mr. Sutton, the superintendent, informed me that the breach had been repaired at Tonawanda, 80 28 to permit boats to pass, and that the lock at Black Rock had been enlarged so as to allow the large and beautiful packets to reach this city by Wednesday, 3dinst. C Bromly, of one of the new packets, has been the spot, aud is: well pleased with the progress of Mr.S. Capt. B. is one of the moat gen- tlemanly masters on the canal, and will continue,as heretofore, a great favorite with the travelling pub- Jesse—(In the same low tone of voice) —* [f you were not shielded by the dignity of that bench, sir, I wouldn’t take thai.” The second reply to the Judge, struck his dignity “ across the face and eyes,” and he ordered the sheriff to take Jesse into custody. Jesse hearing the order given the sheriff, darted throwgh the crowd, with the sheriff after him, over men, boys, and benches, creating a tremendous confusion and excitement, particularly among those who had been knocked “heels over head,” aud trampled under the feet of both Jesse and the Sheriff. By accident of the Sheriff’s clumsiness in falling down the steps, Jesse succeeded in making his escape, uninjured in any other particular than being very much biased. So completely did this disorganize the Court, that a recess of a few minutes was held to get things in order again. The Congressional campaign in this district, sub- ject to a Conventional nomination, to tke place shortly, has fairly and warmly opened. Three can- didates on the whig ticket are already in the field, and nave, each and all of them, several times ad- dressed their fellow citizens, and avowed the prin- ciples which chall govern them, should they be so fortunate as to receive their confidence and support. The Hon John Sprigg, our late representative, has expressed his determination to not submitto a con ventional nomination, but to run on his “ own hook,” and the laurels he won at the late session We had the pleasure of hearing Mr. Tomasson, one of the candidates in nomination, last evening, when he affirmed that the democratic party had no principles at all; that one day they were for a parti cular measure, and the next, they repudiated it Mr. T. said that (Leive the substance of his re- mark) the majority of the democratic party were in favor of a whig tariff, but were afraid to acknow- ledge it; and put the question to the democrats pre- sent to that effect. When the learned “Simon pure of democracy,” rearing his head a full ** feet” above the heads of those that surrounded him, sung out in a senorous voice, “ No, never.” The ques- tion was put again, and nobody replied, but the same, ‘No never.” Mr T. said “| expected no thing else from his brother, but I ask the democratic party.” This caused a tremendous cheering, and the learned was soon seen making his way out of the crowd. . Business continues dull here; but we look for an improvement so soon as the weather becomes a little settled, and Miller’s milennium month passes by. What is the cause of the irregularity of the mails? Can’t you stir up Capt. Tyler and the Post- office Department? Some times we don’t get a mail for ‘wo or three days The Herald, as formerly, continues to be the first New York paper sought for on the opening of the mail, and Mr. Hawks, your agent here, appears to study your interest (and his own) “toa dot.” Yours, &. 8. Title to Real Estate—A . An alien, who is not an enemy, as the law hereto. fore has been, and is now considered, cannot take real estate as heir, although he y take as a pur. chaser, subjectto certain disabilities. Upon the de- cease of an individual leaving no heir, except one who is analien, his real estate does not descend, but escheatsto the government An «lien purchwercan enjoy the estate himeelt, until office found,” which isa proceeding ingituted in beba!t of the goverument to ascertain the alienage, and thereupon to have the estate of the alien declared to be forleited to the Government, but in detault of such proceeding, the estate will not descend to his heir, although such heirbe a citizen released from the right of gevern- ment to have a farteiture for such previous alienage. Neither can an alien purchaser convey his estate to a citizen, divested of the right of the government to make inquisition, and thereupon to have an scheat. although the citizen purchaser bought the estate in good faith, at its fair value. Such are the disabili- ties of an alien in relation to the ownership of real estate, as understood and sustained at the present age. "The only principle vpon which these disubt- lities can be sustained is, that the government, #8 a means of self preservation «nd protection trom fo- reign influence, must be clothed with power to pre- vent an alien from acquiring an inde feasible estate in the soit of the country. The principle is asound one, and should be adhered to so tar and so far only Yours, Cousins. | as the self preservation of the government and. its Buffai epecine from foreign influence may require. falo. Politics Religion—Theatricals—General Matters, &c. §¢, James Gorpon Benner, Esq :— Dear Sirn— As your numerous correspondents of this city have fora long time neglected (o turnish you witha passing chronicle of the tmes, I am again induc- ed to snatch a few moments from my business pur- suits to converse with you, and through the celumns of your paper, the people of the whole civilized world. Alter a long and tedious winter, spring-time in all its loveliness has again burst upon us. The wild birds of summer may again be heard warbling forth their sweetest id the season of roses and flowers will soon be with us. The fields and lawns are covered with their beautiful carpets of green, and the forest will soon be clothed with lovely and luxnriant fohage. As usual during the winter here, trade has been remarkably dull, but as the business season is about commencing, it begins to er up, and the pros- pects of the season, so far as I am ableto judge, are quite flattering for those who manage their affairs ina prudent manner. The credit system among us has almest entirely exploded, and those who pur- chase goods cf our merchants, asit should be, are obliged to give an equivalent therefor. This will enable regular traders, tho-e who wish to maintain their credit in your ety, to meet their creditors promptly and honorably the present spring. | am aware that the credit of our Builalo merchants has been somewhat impaired in New York for some years, produced in a great measure by irresponsible meu, those who, when they purchased, never in- tended to pay. Lam sorry to say we have had such men among us, but it is a lamentable fact, the truth ot which is well known to your neighbors in the metropolis. However, in justice to our regular mer- chants, I am constrained to ay a better state of at fairs is developing itself among us. There may, even atthis time, be a few exceptions, but they are rare, and comparatively trifling. Buffalo, from her nar ral and artificial advantages, is destined to be- come a great and flourishing depot, and am glad to be able to inform you that indications of a more healthy state of affairs are prevailing here I have little to communicate in reterenee to moar y matters, except that it has been exceedingly har to obtain any considerable amount, even upon youd unencumbered real estate since the explosion of our Suflalo banks, The banking houses of Mesers. Lee and Seymour offer advantageous facilities to those who Wish to transmit funds to the eastern cities; bu ‘heir means are entirely too limited forthe busines ota city hike this. They should have correspondent» to all the cities of importance in the country, wher their drafts woald be payable at sight. In the case the advantages to the commercial communis vould hardly be estimated. The auction and commission houses of this city appear to have commenced a he'd el season ‘he principal houses are those of Messrs. Faulkner and Plimpton, C. M. Martin, Marcy & Rollins and operate. Analien may purchase and hold real es- tate subject to the right of government to divest his title, and it would seem to follow as a necessary consequence, thatan alien who is heir to a citizen should inherit, subject to the right of the government to divest his estate, whenever the government should consider it necessary to dose. Such doctrine would be more in accordance with the enlightened prin- ciples of government and individual right, as now understood and inculcated in the United States. No one can pretend that the political existence of the government can be endangered by allowing an alien to inherit real estate, subjr ct to the right of go- vernment to divest the estate, whenever the exigen- cies of the government may require, anv more than byallowing such alien to take ae estate by purchase, subject to such right of divesting it The principle is also inapplicable to the case of a purchase by a citizen frem an alien, honestly made, because the moment such ownership 's acquired by a citizen, all danger which may arise from foreign iniluence ceases to exist. Connected with this subject it is also important to enquire, to what government, in case of amescheat, tor the cause of alienage, does the estate go, the National or State sovereignty ? It has heretofore been considered as a matter of course that the escheat is for the benefit of the individual State in which the land escheated is situated. The propriety of this is doubted—the national govern- ment has the power, and has exercised it, of saying what shall release an individual trom the disabilities of alienage—it also has the entire control ot our tor- eign relations, and it would seem, is the government to be protected and guarded against foreign influ- ence, In 1794, by peaiy with Great Britain, citi- zens of England who then held real estate within he United States, were in relation to such real es- tile, released from the disabilities of alienage, which xemption extended to the heirs of such aliens. In case of any such alien, no State could despoil him of bis property—and no reason is perceived, which can righifally authorise an individual State from in- res in acase not embraced by the treaty of ‘These suggestions are made to call the attention of the public mind to a consideration of the subject. The United States have made great advance in the science of political economy; this advance will fail of itsperiect work unless similar advence is made in its judicial principles, so that every departinent of the government may exhibit an harmonious part of asymmetrical whole. Jt seems to the writer Most consonant to en enlightened jurisprudence that an alien, who is not an enemy, may hold realestate by descent as well as by purchase, subject to the right of government to divest’ his tithethat such ghtshall not be exercised against a citizen who is, in good faith, a purchaser from such alien—that an scheat when it occursshall be to the United States od aot to the State in which the land may be sitna: Chvis.
