Present prices are such as to af- ford a handsome margin for such operations. The Bar- ings, Morrisons, aad Lisardi, were large holders of Ohio, atan average of 60. The last accounts they hadof prices here these stood at 71. This offers a handsome margin. The stockholders in the Merchants Exchange Com- pany are going to contest the bonds; anda perfect right they bave so todo. The directors never called a meet- ing of ‘the stockholders, nor thought it worth while to consult them at all. After they had expended the capital, unbeknown to all but afew in the Board, they took upen themselves the responsibility of mortgaging the building, and thus creating a capital of nearly (wo millions,when the Legislature had only granted the charter for the one mil- lion. Every chartered Bank is required on the Ist July, 1843. to deposite with the Comptroller their bill plates, with a full and accurate account of all the notes outstanding on that day. No bank thereafter to issue any notes not countersigned and registered by the comp- troller. {application is made tothe comptroller for notes faster than he can supply them, the banks may reissue as many ofthe old circulation as may be necessary. Thi stockholders to be individually liable for all old notes outstanding after July 1844." After July 1844, no bank shall issue a note not countersigned and registered at the comptroller’s office. All noter issued priorto July, 1943, and not countersigned before July, 1844, shall on that day be destroyed in presence of the comptroller, who shall prepare a certificate to that effect. Src. 2. The comptro'ler shall keep the plates, and de- liver to the banks such notes as they requireto an amount, which, with all previously outstanding, shall not exceed the amount pow allowed by law. all employ suit- able persons to sign all notes which shall be ney fore delivery te the banks. The expenses to paid by the banks. : Src. 3. Every bank shall make a full report of its re- turns on the first Mondey of August 1843, and quorterly thereafter. The comptroller shall publish all their re ports, with asummary, in the State paper; and each bank shall publish its own report in a newspaper in the county where it is located. Sec. 4. Thecomptroller shall publish the reports and summary in one paper before the 20th of August, Novem- ber, February and May in each year—expense to be paid by the banks. If any bank fails to make its report in time, it shall forfeit $190. The charter shall be forfeited if the report is not made in two quarters. Src.5. When it shall appear from the reports that the capital of any is reduced, the comptroller shall oblige itto redeem its circulation to the same extent. Src. 6 Abolishes the office of bank commissioner. When the affairs of any bank require it, the comptroller shall eppoiut s special agent to examine it, who shell havethe same powers as the present commissioners. If the bank is found delinquent, it shall pay the expense of the examination. Ifnot. it shall be assessed upon all the banks. Sec. 7. Any bank on pa: dues to the safety fund, and such as it would be liable to if it existed the length of itscharter, and all other liabilities, may wind up its affairs and distribute its assets among its stockholders ‘Sxc. 8 Repeals all laws conflicting with this act. This law does not appear to afford any other increased security to the bill holder, than that which arises from guarding against illegal issues—such as those pledged by the Buffalo Banks. Here is then an apparent and great injustice created, inasmuch as banking associations are obliged to deposit adequate security before they can receive bills from the comptroller, while the chartered ‘yanks get them without security. Here isa went of uni- formity at war with principles of justice. The feature of quarterly publications is excellent, end will be of great service, anda guide, not‘only to business’men, but to all other banks throughout the country.
