Mr. Dugr made a few remarks in support of such testimony, and said it was their right to adduce it on the part of the accused at any time during their de- fence, as it would go far to prove the guilt of Spen- cer. The Court was then cleared, and on our readmis- sion we were informed that the testimony desired by the accused could not be received in evidence. Atthe request of the accused, Wales was recalled to say if he understood from Spencer who was to have the posts of first and second officers on board of the Somers after her capture. To this Wales re- plicd that Spencerdid not tell him, but he presumed Cromwell was to be the first officer and Small the second officer, witaess being the third. By the Jupae Apvocate.—Spencer did not tell me who were to have the posts of first and second officers. He did not mention Cromwell’s name,nor any name to me. He, Cromwell, was about 35 years old, of an athletic make. Small was about 80, of slight and active form. Here the witness said he would wish to correct some portion of his testimo- ny; he did not mean to say that all the petty officers were armed at the council of officers, for only — were armed at that time. The others were armed on the day of execution. s Q—By the Courr—Do you understand naviga- tion? A.—No. Q.—Then how do you know that Cromwell un- derstood it 3 : A.—Because I’ve seen him working out a day's work. [‘ve seen him with Mr. Spencer and he would tell Mr. Spencer where he was wrong. Q.—Do you know that Small was mate of a ves- sel except from his own assertion ? A.—No; he told me so. H.M. Hetskeut, sworn—I was the purser of the Somers during her last cruize; first heard of the mally from Mr. Wales on the morning of the 16th Nov. {Here the witness went into all the details of his conversation with Wales, which has been so often reported.) , i . Mr. Duerstated after that part of the detail had been given by the witness, that it was not their in- the case, except in support of Mr. Wales. It was their intention to pursue the same course with Lieu- tenant Gansevoort, and having got that partof the case fully proven, then go to the other points on which the defence rested, s The Jupce Apvocare said in that case he should not ask him any questions now. Lieut. Ganszvoorr examined—I wason board of the Somersas first Lieutenant; heard of the intend- ed mutiny from Mr: Heiskell,. the purser, on the 16th Nov., about 10 o’clock in the morning. Wales met me by the fore hatch, and told me the pursér wanted to see me. {The witness then went on and related his con- versation with the®purser, as that officer had heard from Wales of Spencer’s plan, to capture the So- mers by making a row in the mid-watch, and throw- ing the officer of the deck overboard. The witness went on to state what measures he took to watch Spencer and to satisfy himself of his guilt, previous to the arrest, and of his own recommendations that something should be done to secure Spencer, “He also testified to the facts which occurred at the ar rest of Spencer in precisely the same language as be- fore the Court of Enquiry.) Ta answer tothe second question on the part of the accused, the witness proceeded to give the par- ticulars of the carrying away of the top-gallant mast and the arrest of Cromwell and Small. He alsosta ted that on the evening alter this second arrest, Spencer asked him if Cromwell was confined for any thing in which he, Spencer, was concerned.— Witness replied yes, on which Spencer said Crom- well was innocent, as he, Spencer, did not think Cromwell would join unless there was money on board. On a subsequent occasion Spencer said Cromwell was innocent. ‘The witness was about to detail some conversa- tion between himself and Small, which the Judge Advocate supposed was intended as proot of Crom- well’s participation inthe mutiny, and he stopped the witness. A discussion then ensued between himself and Mr. Duer, as to the right to give such testimony. At last it was admitted by way of repel- ling the imputation of having hung Cromwell from malice prepense f After this testimony was given, a question arose as to the testimony taken before the council offi cers, which document was not in court. lt was finally decided that it was necessary that the teeti mony before that council must go on the record, and in order to allow time for the copying of it, the court adjourned till this day at the usual hour. I Mr. Sanford gave notice of his intention to intro- duce a bill for the incorporation of the N: Y. A petition was presented the other day for the abrogation of all laws for the collection of debts and this conceited mass of vanity perpetrated what he considered a joke, by moving the reference of t! petition to the N. Sentenced.—William Ward, for an assault and Dr. Sanborn, of the popular “Cornucopia,” Pat 7, was fined $16, and for a similar offence committed on Ro- b Sears, one of the polite and attentive assistants of thet establishment, was sent to the city prison for ten days. John M’Kay, indicted for robbery in the first degree, im taking fifty cents from Robert Saterthwaite, on motion of James M. Smith, Jr. was allowed to enter a plea of guilty of assault and battery, and a nolle prosequi was entered by the District Attorney on the ether charge, he having ex- amined the papervand found that no other charge could be sustained. The Court then sentenced him tothe city prison for ten days. James Smith and Austin Smith, cntered a plea of guilty pa! f ae and battery on Isaac Hamilton, and were fia. ed $5 each. Joseph Waters convicted of beating Bennet P. Norris, was sentenced to the city prison for ten days, and fined $25. Trial for Assault and Battery.—John Malay,John Buck- assault and bat. tery on Henry Miner, on the 8th of last November. Lymen F. Hinentey stated that defendands assaulted Miner while he was in the performance of his duty as special deput: Sheriff, at the poll of the second district of the 12th wi at the election on the 8th of November last. The indict- ment charged that Hinckley was assaulted bat no mention was made of Miner’sname:nit. The result was that the jury returned an immediate verdict of aot guilty, and the parties were dischai iy 4 in the First Degree—A young man named John Reed, a butcher by trade, was tried for attempting to enter the store and dwelling house of Mrs. Susan Gaff ney, widow, of 206 Cherry street, on the morning of t! oth of December last. It was proved that at 4 o'clock in the morning the window shutter of the store was forced open, and window broken, but no goods were stolen. The accused was arrested by John D. Wood, a city watchman, aided by James Breslin, a few minutes after the window wae broken, He was ranning through the street with another man in compemy with him and when arrested denied the charge,and said he was running through the streets to keep himself warm.
