Literary Notices. Sarceanr’s New Moytmiy Magazine. —This is the first number of a new Magazine of “Literature, Fashion, and the Fine Arts,” edited by Mr. Epes Sargeant. It waspreceeded by a tremendous flou- rish of trumpets, but we never met with such a dis- appointment, The literary articles are of the most flimsy and slip-shod character, containing apparent- ly the mental fragments or rubbish of the contribu- tors—a dish of perfect literary “eold wittals.” The printing, and embellishments, are very poor. The type seem to be second-hand, the paper so thin that the ink looks through, and the eagravings the worst that we have seen in any fashionable magazine. We are sorry for Mr. Epes Sargeant—he is an ami- able man, of some talent, were it properly directed— but he makes a poor first appearance. Under our tuition, we could make him twice the genius and man of talenthe is. He has the raw material, but he does not know how to work it up. Lives or THe Presipe tts or THe Unrrep States. — By Robert W. Lincoln, New York—Published by E. Kearney, 56 Gold st.—Thisis a large handsomely bound octavo, of 578 pages. In addition to the lives of the Presidents, it contains biographical notices of the signers of the Declaration of Independence ; sketches of the most remarkable events in the histo- ry of the country ; portraits of each of the Presidents, and 45 other engravings. This is a volume of great value to every American citizen, and especially to the American youth. Itisan invaluable work for every library, and pardaclarly those in country towns and villages, where rarer and more volumin- ous works are not easily acces-ible. It appears to be written and compiled with great impartiality, and much good judgment. At the close of the vol: ume isa valuable chronological list of the officers— the Presidents, Vice Presidents, and the heads of departments of the government. We take great pleasure in recommending this asa volume to which every American citizam should have access. Hunt's Mercuants’ Macazine.—The December nu» ber of this valuable work, completing the 7th volume, fully sustains the high reputation enjoyed by the work from its start. The leading article is on the commercial decline of Spain, and contains a review of those political causes which have con- tributed to its commercial ruin, and devel- opes the disastrous consequences of “protection,” or government interference, with individual aflairs. There are many other articles of merit, with some elaborate or rather fancyful remarks on the progress of population and wealth in the U. The typography, paper, ea- gravings, and entire mechanical execntion, are really beautiful, and reflect the highest credit on the well-known publishers, to whom we have much pleasure in according that merit which they so emi- nently deserve in placing a work of such unequivo- cal value within the reach of all classes. The plain- tiff isa well known dealer in india rabber shoes, at No. 66 Chatham street. ‘The defendant, Mr. H. H. Day, is the proprietor of the extensive india’ rubber factory connect ed with the Roxbary india rubber establishment 45 Maiden lane. It appeared in evidence that the manufacture of india rubber shoes, by the mode of cementing the parts with dissolved india rubber, as described in the plaintiff’ pa- tent, had bren in use for many years prior to the date of the plaintifi’s patent. The plaintiff claimed to be the first who used sheet india rubber, and on that subject it was testified that shoes had been made of sheet rubber before Sees patent ie Judge charged decidly in favor of the defendant— and the verdict of the jury was for the defendant. Coe vs. Edward Cwr- tis.—This was an action to recover back the duties on the importation of an article alleged to be gunny ‘cloth ‘The duties were charged upon it ascotton bagging. B: the law of 1832,a duty of 34 cents per square yard,was laid on “cotton bagging.” Since which an article has been im- ported, made ot jute hemp, and used for packing cotion— ‘he article was pot known atthe time of the law. Wirtina, Eq. District Attorney. Dre. 7.—S —Michael Kelly, the young man who entered a plea of guilty to a charge of forgery in the 3d degree, in signing the name of Edwara J. Mann toa bill of Exchange for £160 sterling, with the intent tede- fraud Jonas Centre, was sentenced to the State prison for two years. Trial for Libel —The trial of Orazio de Attellis Santan - geio, fora libel upon Samuel McRoberts, United States Senator, from Illinois, was commenced at the opening of the court. The libel charged iscontained in a pamphlet of some thirty pages, published by Santangelo on the 26th of July last, in which the epithets of ‘ consummate jack. ass,” * knave,””“ miserable paltroon,” “ ourang outang,” 'y.” &c. ure applied to’ McRoberts, and also ve of every thing that ie mean, dirty, jous,covetous, sordid and cowardly.” attack appears to have originated in some difficult; that arose between the parties from a loan of money made by McRoberts to Santangelo on Mexican certificate of stock as security, It appeared in evidence that on the 6th last McRoberts loaned Santangelo on @ cer. tificate issued under the Mexican Convention, dated March 26th, 1842, signed by T. L. Smith for $200. ‘This certificate was to be returned if the $50 was repaid in two t at the rate of six per cent per annum. An advance of $125 was made on ther certificate on the 16th of April, for $500, which to be returned on the repayment of the money with six per cent interest.— * On the 23d he advanced $253 50 on a certificate for $1000, on similar terms, and on the 25th, $125 on a certificate for $500. receipts given by McRoberts were drawn as ‘es had been purchased out and out — dvanced was to be returned on the 6th of June,according to agreement when the certificates were to be returned. Sentengelo could not meet his engage- ment, and asked for more time to raise the money, which McRoberts refused. Soon aff\ he came to this city and pnblished 309 copies of the pam; which forms the basis of the prosecution. This pamphlet was add “A cir. cular to the World,” with an additional head of ‘*Isthe honorable Samuel McRoberts, more honorable than the honorable Mitchell?” The publication of the let was proved by Mr. Turney the printer, who thet the manuscript was furnished him by Santangelo. On the Mh of Angust it appeared that MoRoberts published a pamphlet in reply to Santangelo, in which he aj epi- thets quite as severe as those used by his opponen Santangelo, it appears, was compelled to jeave the king- dom of the two Sicilies in 1821, after the fafl of the const tutional system, for political offences, but was allow:d to return in 1896 by a royal decree. Since then he resided in Mexico and edited # sf there called the “ Correo At- lanatico,” but was com) to leave on account of his in- terference in the political affairs of the country. The mixed board of commissioners appointed to settle the claims against Mexico awarded Santangelo $50,000 in cer- ‘ificates against the Mexican Government. ot esvert he resided in New Orleans in the capacity of a teacher. Yr retorted, and wor's passed between them that in ail probatitity wonld have elther terminated in a fist fight or a duel,had not the Court promptly interfered to re- cuncile the gentlemen. ‘The prosecution proved by Robert Beall, one of the at- tendants of the United States’ Senate chamber, that McRo- berts sent him to the house of Santangelo on the 6th of July with the Mexican scrip that had been given him as security, with a request that the money advanced might be paid when the scrip would be returned. The defence proved the good character of Santangelo, and the testimony closed at 6 o'clock, when Mr. Price com- menced summing up forthe de'ence.
