Hoyt.—This was an action of Trover, to recover a note for , obtained by the brother-in-law of defendant (Mr. Lockwood) under pretenceof cashing it. Lockwced had stopped payment, making Mr. Hoyt his assignee. The note in question belonge1to B. Lioyd, who had also stopped; and owed Lockwood for a billof The parties were at the public house, corner of Nassau and Vine streets. Lloyd had given the note to Trippe for the latter to raise money upon, and Lockwood thought it no harm to convert it to hisownuse. After getting possession of the note, Lock- wood went away, promising to be back with the money in 15 micues, but was soon on his way to Albany, where tue defendant lived, and handed the note to him as part ef his effects.
