Oakley vs. Monmouth B. Hart, sheriff. —In 1335 Charles Oakley was worth a plump half mutliun— he had been an extensive tebacconist, also a ship- ping merchant, and possessed a large Janded estate—he sided in a splendid mansion in Bieecker street, was Presi- dent of the Greenwich Bank, subsequently of the Green- wich lusurance Company, aud is yet Vice President of the Greenwich Bank for Savings, and also one of the most ac- tive and useful members of the Pubiic Schoo! Comimittee— moreover he was eminently conspicuous in politics, and the great gun, on the whig side, in the Ninth ward. Yet, hike many others, he became entrapped in bubbles, (hav- ing lost, it is said $190,000 in the North American Trust and Banking Company alone ;) his household iuruiture was sold under execution in 1540, and he is at the present moment a petitioner in Bankruptcy, having, it is feared (judging from the evidence) made Many other hearts be- sides his own to ache in efforts to save himself. ‘Khe pre sent is an action of replevin, brought by his daughter to recover @ piauo forte and a quantity of silver ware, taken at the residence of her father in March last, on an execu- tion against John R. Oakley, (her brother) who bought the furniture when it was sold in 1840, but the piano forte and silver had not been included. Mr. Charies Oasley testified to having bought the piano for the plaintiff, about 9or 10 years «go, When she commenced learning wo play, and made her a’present of it—the plate was given to the plaintiff’s mother at the time of her marriage to witness. The mother is dead, and when the witness married again in 1835—(having at that time become united to a widow lady named Cook)—he gave the plate to his daughter, ac- cording to custom in such cases. He was then in afflueat circumstances, Strong effort was made to impeach the testimony of Mr. Oakley, as the resuit of thy trial must de- pend upon tne credence given to it by the jury, and seve- ral witnesses were produced to that effect. Mr. Van Voor- hies, stable keeper, Grove street, said, he would not be- lieve him under oath, as did also Mr. V.’s son. Mr. Gar- dinee, Hudson street, ‘and several other persons also made declarations to the same effect. ‘To rebut this, messrs, P. W. Engs, J. W. Gerard, J. W. Suydam, declared their opinion that his Mr. Williams, lately his coun- sel, begged to be excused from answering the question, whether he thought him worthy of beliet nuder oath or not. Mr. Oakley, on being placed upon the stand again, said he had had diputesor tigation with ail the witnesses who had spoken against him. [From the evidence it would seem that Mr. Oakley had been a severe landlord, anu unfortunately is made to feel the effects of it in his hour of reverse.) AssauLt on an Aupeamay.—Valentine Mager and George C. Sherdian, were tried for an assault and batte on John Steward, Alderman of the ldth ward, onthe 26th of June last. Alderman Stewart deposed that on Sunday the 26th of June last, he went to the house of Mager, at't01 Elizabeth street, and there found a band of music playing, and ple drinking on the premises. He informed the assemblage that he was'an’ Alderman, and ordered them to disperse. On getting upon the table to give his orders with his staff ofottice in hand, the defendants pulled him down by his coat tail, and he was otherwise assaulted by the com- peycnw Couvim, street inspector of the 14th war, confirm. ed his statement. Wat. Sacer, Esq. opened the case for the defence and commented in strong terms on the brutal outrage commit- ted on the feelings of these innocent citizens by Alderman Stewart, who, inebriated by power had resorted to this mighty mote of doing business instead of resorting to t usual mode of entering complaint at the Police Office, if the house was actually one of a disorderly character. That the night in question was dark and rainy, and on the assemblage of gentlemen and ladies being ordered out in this peremptory manner, they went without hesitation. Het! question, the company out. Jacon Evsatt, one of the watchmen who went to the house, also saw Stewart strike him (Mager) while in cus- tody of the watchman—there were twenty to forty watchmen selected to go to the house. Srroxc, Esq, managed the prosecution tn the absence of the District Attorney, aad offered a very sound argument to sustain the Alderman in the course pursued. Wo. Suater, Esq., then rose to state that, in his opinion ofthe law, the Alderman had no right to enter the pre- mises of Mr. Maagr with a procession of 40 watchmen, and that ag there was no necessity for violence, the blow: in- flicted by Alderman Stewart were contrary to any power possessed by him. ‘The Recoroenr charged that the offence complained of, and for which Alderman Stewart entered the bouse, was one under the broad basis of the common law, and if com. mitted he was so amenable, that many acts apparently in- nocent in themselves, were nuisances in the eye of the law. The nightly playing of a drum and fife under the window ofa dwelling, although the music might be ogree- able to some, yet if continued would be considered @ nuisance as well as the assemblage of persons at public worship who occupied very late hours and disturbed the neighborhood. That the evidence relative to the assault ‘and battery was very contradictory, and that although the Alderman had a right to exercise the power ofgeanenting @ nuisance, yet such power should be most carefully wisely exercised.
