Smith, Esq. as counsel for the pub- lishers of the W' hip and Fh stated that he was not ready to proceed to trial, and asked the eourt to setthem down for Wednesday next, which was granted by the court. The case of Scott and Vanderwater, publishers of the new Flash, was also called up, and @ postpone ment also granted ull Wednesday next, The counsel forthe parties in the above case: admitted the publication of the papers named, gt: the only question that will devolve in the trial, is whether the matter published is libellous, or whe- ther they contained obscene language. Libel “on Senator McRoberts —On motion of Messrs. Purvoy and Price, counsel for Oravio de Attellis Santangelo, who is charged with publishing a libel against Samuel McRoberts, United States Senator from Illinois, in a pamphlet relative to the loan of some money to the former on Mexican Bonds, was allowed to go off till November next, in order to allow the defendant time to obtain copies of certain public docum: from Washington, and also evidence by commission from Matanzas. Sena- tor MeRoberts was in attendance in court. Trial for passing Counterfeit Money.— A German named John Shultze, was tried for forgery in the second Re ree, in passing a $B counterfeit note pur- perdin e of the Greenwich Bank of this city, upon ra Hogan, of 99 Greenwich etic on the 19th of July last, in payment fora glass of liquor. On arresting hum at the time, another note of the same character was found in one of his pockets, and some change insilver. The defence proved a good character for prisoner by a number of German witnesses, and there being no evidence to show that prisoner knew the bills were counterfeit, the jury stared a verdict of not guilty. of Wm. J. Snelling.—This person, who hae ncctad as one of the editors of an obscene sheet called the Flash, which was published some months since, was calledfor trial. George B. Wool- dridge was called as one of the witnesses, and stated that several of the articles that appeared in the sheet, offered by the District Attorney, were writ- ten by Snelling. The District Attorney then read several extracts from the paper to show its general character, Snelling defended his own cause, and stated to the jury that the article relative to Tom Hamblin contained nothing that was obscene or indecent; that there was no proof that he had written any other article in the paper. The Recorder me OF the jury that if the charac- ter of the paper was of an obscene nature it was all that the jury need know in the premises, as there was no special offence charged beyond that. ‘The jury after an absence of half an hour, and re- turning inte court once to ascertain some ppamte of evidence, returned a verdict of guilty, and he will be sentenced on Friday of the third week of the court. Otis Allen and William E. Ross, were arraigned on two new indictments and remanded to prison. ‘The Court then adjourned to Monday next, at 11 e’c! oe k.
