Now the basis of the discounts of accommodation paper is the principle of preferred debts. In almost all cases of failere, accommodation paper has been protected by preferment on account of the endorsers. This state of things the bankrupt law breaks up, and accommodation paper will, therefore, as a matter of necessity, be henceforth excluded from the banks. In order more fully to understand the operation, we may look back at the progress of events in the Stats of New York in relation to banks. For instance, in 1925, the amount of bank capital was $25,105,000. In 1326—7, 8, no new bank charters were granted. In 1529, the safety fund bank law wes created, and 16 old charters were re- newed under it. Twenty new banks were created with a capital of $4,700,000; during the same period, seven banks failedjwith a capital of $1,950,000, and the capitals of the National, Tradesmens’, Dry Dock, aad City Banks, were reduced $2,220,000. This sum is the difference between the nominal and real capital employed under the old system, when banks were allowed to go on and do business whenever 15 or 20 per cent of their capital ‘was paid im; consequently the real capital could not be arrived at. When the safety fund was adopted, the policy was laid down of creating no new banks, or of renewing old charters, ex- cept under that law, consequently there are now but five chartered banks not under that Ia’ Under the free banking law the policy has been adopted of crea- ting no now banks, nor rechartering old ones, in order to bring all under that law. The result is, that all the banks doing business must have a bona fide capital, which must be invested in stocks, and form the basis of their circula- tion. As long as New York State stocks are in existence, which will probably not be more than twenty years, this system will answer well for a moderate amount of capital only, bocause the profits of banking are derived not from the loan of capital but the loan of credit. By the regala- ting power of the bankrupt law, thoso credits will be re- stricted to bona fide transactions at low prices, requiring comparatively but a small amount of money; the profits of banks will therefore be powerfully circumscribed. ‘This process has been going on in New York for some time, having begun with the reaumption in May 1835, and the results are already evident in the reduction of banking in all parts of the Union, amounting as we have seen, du- ring the past year only to $70,000,000. This may gradu- ally extend until not only New York is greatly reduced, but the capital of the whole Union be contracted $150,- 000,000 more.
