Colt, stated that himself and associates were pre- paring a bill of exceptions, a'so affidavits in rela- tion to the Jury, and reqnested that further pro- ceeding the case ego postponed to next term, whieh would be in March. Judge Kewr, after consulting with his associates, stated that the Counse ould have afortnight al- lowed them, which was ordered. The counsel for Tappan stated that some of the witnesses were now in the interior part of the Stat and it was necessary they should be present. He : id not suppose it possible they could be ready this erm. The District Attorney remarked, that as the case of Adams was to lie over, he had no ob ctions to this taking a similar course. He was desirous of taking come testimony, de bene esse, and asked leave to that effect, which was granted, and the trial was tponed. The old panel of jurors were tl discharged, with the thanks of the Court, and the new panel directed to remain. Mr. Moanitt asked to have the libel case of James Gordon Bennett postponed to next term—he feeling beat out and unable to try it—but the Dis- trict Attorney objected, and the case was set down for Monday next. Judge Kent observed, that a special jery had been sammoned for the Cireuit Court this morning to try the Staten Island case of Wendell vs. Moore. The trial would not come on for a few daysand they were discharged until called upon, with a cantion not to converse on the subject be- tween themselves, nor allow others to speak with them in respect to it—the latter of whieh was a punishable offence. The rogues have been running at large until within afew days, when Merritt was identified while at Mamaroneck, Westchester coun- ty, and arrested and brought to this city, where he was committed yest-rdey at the Upper Police.
