If Colt’s staic- ment that he went to the City Hotel at about dusk, and spoke to his brother were founded in truth, why should so important a matter as this, contra- dicting directly the cestimony of Wheeler, Seig- netteand Delnoce, who declare that no one left the room till ten o’elock, be passed over in silence in the evidence?’ Why was not that brother called to testify to so material a point? It may be said that he has other brot! er . Byt a brother would have travelled {rom one en@fof the world to the othor to testify to so important a point. Smith said it was wholly unnecessary for him to say that the statement of Colt was not evidence; but it might be used against him, though it could not in isfavor. ‘There too was the statement that he dawman to take the box downstairs, directly contradieted by undoubted testimony. Why then not say in this ‘confession’ that he took the box down himself? Because then the mark upon his shouller would have been accounted fer, and to do this was no part of his purpose. And if he did hire the man, why not bring him forward? No; the whole thi got up to act on the passions, prejud: » and sympathies of the Jury, (Here Mr. Smith went ingeniously over the evidence, and showed the contradictions between it and the confession ; the caulking of the box —Wheeler hearing no sobs or groans—Colt just about to leave his occupancy of Wheeler's rooin— the appointed time of the sai of the veasel—his delay in giving up that room—the corresponding delay in the suiling of the vessel. And this shows that this man’s mind is si jituted—and se the dead is amprobable, Mr. Smith pointed out the eontradi the confession and Caroline Hensha' estimony.) He went on :—‘‘As to the mark on his neck, there is ecessity to impeach her testimony, when we consider the ‘ition in which she stands. A female’s virtue is the anchor which binds her to the world; when once that is lost, no matter by what the only tiethat binds her to society is se- vered. She was the mother of the prisoner’s child, and it weuld be strange indeed ifthe young mother would not come forward to testify tae te infavor of the father of her off- spring. (Mr. S. then went over Wheeler’s testi- mony about jthe noise, asjcontradicting Colt’s ac- count of the conflict, and showed that in any view of the case, from all Colt’s acts,he was clearly guil- ty of murder. Colt must have known that ancl blow would kill Adams, before he struck them. He also showed from testimony «f the doctors, that after the first blow Adams must have been powerless ; alse from Adam’s temper that he could not have struck Colt first—if at all. Colt would have had more excuse if he had proved himself to be of a violent temper. Mr. 8. then cited the various au- thorities defining the degrees of the crime, which we have before given, as to the instrument used and the manner of using it being evidenge of the intent We caunot follow Mr. Smith’s admirable remarks, but must conclude with one very beauti- ful passage in his really brilliant speech. He spoke two and a half hours. Mr. Selden two and a half hours, till three o’clock. After the recess, he spoke from four till seven o'clock, in a strain of thrilling eloquence. The security fixed by the court is $1250, for his appearance to answer the verdict rendered against him, which has been carried to the Supreme Court, and $1250 on the two other indictments pending against him. The security has been entered, and he has been discharged from prison. His long incarceration has reduced him to a low state of flesh, and be appears to be wearing fast in both mental and phyeical abilities. Tuosr Deap Bonrrs.—William Boyce, the cart- man, who stands charged with being concerned in conveying the three dead bodies from Potter’s Field to the Crosby street Medical College, for dissection on Wednesday night, was arraigned yesterday at the upper police office. Groner W. Scuvyten, re- cently appointed keepér of Potters Field by the Commen Council, was summoned as a witness, He appeared, accompanied byjJames S. Brady, Esq as counsel, and after being sworn and questioned ag to hisknowledge of the removal of the dead bodies from Potters Field, found in the cart of Boyce, re- fused to answer any thing relative to the case, al- ledging that he “had understood a suit had been menced against him, and he, therefore, could not answer tithout implicating himself!” Justice Pal- mer then informed him that no charges had been preferred against him-to his knowledge, but he still refused to unswer on the ground that he would criminate himself! He was then discharged, and Boyce remanded to prison for further examination. Finr.—The alarm on Thursday evening proceeded from the burning of three two story frame dwellings Nos 702, 704 and 700, Water street. The fire com-, menced in 702, and communicated to 704, which was entirely destroyed. The upper part of the former was considerably injured, as well ae that of 700 No. 704 was occupied by James Chichester, as a segar manufactory and dwelling. Ann is about 45 years ef age, and Mary near 20. The former black hair, the latter red, and are known to the Police as celebrated tor Passing counterfeit moneys.
