MRS, LUDDY WINS FORECLOSURE SUIT Delendant Unable to Show Re- ceipt for Questioned Payment Redemption day was set for October 27 by Judge Stanley J. Tra- | ceski in city court in a judgment for the plaintiff in the case of Mary A. Luddy vs. David T. Larson and others today, the dispute being over the number of payments that had been made on a mortgage note and also on the time to be allowed for redemption of the claim. The property involved is known &s the Luddy property on Church | street, nearly opposite the railroad station. On January 6, 1926, Judge Morris D. Saxe took a mortgage on the property for §19,250, to be paid off at the rate of $500 a month, and interest. One payment of $500 is in Guestion, Mrs. Luddy claiming that $15,750 is dus her and David T. Larson, to whom Judge Saxe deeded the property on May 15, 1929, that the amount is $15,250. The install- ment alleged due was to be made on March 5, this year, and, no proof being shown that the payment had been made, Judge Traceski found for the plaintiff for $15,750 and in- terest, a fotal of '$15,955.68. Mrs. Luddy is thus allowed foreclose on October 27, but mortgage claim of William liams, Jr., may have a week longer. a There are several mortgage liens on | the property, totaling about $80,- 000, with a sales value on the pro- perty of between $50.000 and $54.- 900. Besides the Luddy and Wil- liams, Jr., claims, other claims in- clude those by Henry Morans, Dam- fanos Apostolon, Levio Bassoni, the Hartford Plumbing Supply Co., Fred C. Monier, Jr., of Newington, the New Britain Typesetting Co. and Frank Nair, Inc. Mrs. Luddy claims foreclosure, possession of the property, ceiver of the rents.
