Dorbuck denied that he was at the wheel of his brother's car last Sat- urday night and produced witnesses to substantiate his denial, in the face of positive identification by Officer John Afudi, who made the arrest, The officer testified that he sa fhe car on Park street near I «bout midnight and as it was fc lowing an uncertain cou he | tashed his light for the driver fo <top. e then blew his whistle but veither signal was obeyed. The officer ordered jim to walk a few yards and ob- scrved that he staggered, so he ar- 1ested him. The officer drove the car to the police jon with Dor- luck beside him. the latter's com- panion getting out of the car, Officer Thomas Tierney and Se geant J. C. Stadler testified that they were at police headquarters when Dorbuck was brought in and he was Unsteady on his feet and unfit to| drive. They smelled liquor on his lLreath and Sergeant Stadler said that Dorbuck at first denied that i had been drinking but after taking the walking test in the corridor h admitted that he had imbibed. Admits Drinking Dorbuck, who was represented by Attorney B. J. Tony Brown of tiquires street, Iartford, was driving, lio said, although he has no oper- ator'’s license. On Park street, Dorbuck said, he was in the car between Brown.and Tony Savan of 96 Seymour street, when they stopped to buy cigarettes. Brown went into a store and before lie came out Officer Auidi approach- «d and asked who owned the car. 1o which Dorbuck replied: “I do.” \sked who was driving, Dorbuck and ‘avan replied that Brown had been | «t the wheel but was at that moment | i the store. Then the officer gave Dorbuck the walking test and re- 1narked that although he did not ap- pedar to be unfit to drive he would have to go to the police station and | be interviewed by the ofticer in church. Demand For Physician Denied Dorbuck claimed that he tried to | tell the officers he had not been driv- ing and he also demanded that a physician be called to examine him it none was called. Ixplaining his rcason for not driving the car al- though he has a license, Dorbuck said Brown wanted to take the wheel o he allowed him to do so. Brown and Savan corroborated Dorbuck’s testimony, and a young | woman living on Oak strect, told of \ccepting an introduction to Brown en North street about 45 minutes | prior to the arrest and at that time| Brown was at the wheel and Dor- buck was beside him Sergeant Stadler recalled to the stand denied that Dorbuck had pro- tested that he had not been driving.
