The Porters admit- .|ted to and told 8. Gerard Casale, an attorney at law, that such evidence and testimony given by them be- fore the special master was untrue, false and perjured for the purpose of deceiving this court.” Hinges On Hornkohl Bankruptcy The history of the case according to the fact set forth is as follows: Fdward Hornkohl of New Britain who conducted Eddie’s Filling Sta- tion and dance hall and club on the Newington turnpike, went into bank- ruptey in 1925 and Mr. Fox, who is| in Mr. Albrecht’s office, was ap- pointed trustee of the bankrupt estate. Hornkohl leased the premises of 53 acres from the Scheidls. It was claimed by the trustee that the bankrupt had an agreement with the - | property. Scheidls by which the latter agreed to convey to Hornkohl the Newing- ton property upon the payment of $1,000. The Porters are alleged to have testified that they saw such an agreement passed between the two parties. It is now claimed that they deny the truth of the assertion. The trustee sued to enforce the agreentent and Mr. Berman found and a judgment was entered that the trustee pay the Scheidls $1,000 in return for tke property or thc | Scheidls pay $7,000 the value of the The Scheidls did not comply. As a result, the federal judgment was prosecuted by the foreclosura proceedings in the superior cou.t |against the Schcidl property. Mr. McDonough was retained as coun- |sel by the Scheidls. Attorney David L. Nair is counsel for Hornkohl. Redemption Day Next Tuesday ‘Through an inadvertence of his secretary, Mr. McDonough's appear- that there was such an agreement | ance in the case was not properly filed and he was not notified of the hearing on the foreclosure, he told Judge Yeomans. For that reason, he said, he wanted the judgment open- ed becausc redemption day falls next Tuesday when the Scheidls have to redeem the property or lose it.' He stated that if the stuy were granted, he was confident that he could securc a new hearing, prove the perjury and get a reversal of the federal degree. George E. Rubinow has since been appointed trustee of the Hornkohl estate and is represented by Attore ney Joseph G. Woods. AT DEMOLAY INSTALLATION About 35 members of the Rain- bow assembly and Masons of this city attended a public installation of the Order of DeMolay in Bristol last evening.
