When the hearing was half over, { Judge Saxe informed counsel for the plaintiff, A. W. Upson, that from the evidence presented by the plain- ti® herself and other witnesses, it {apepared more like an assault and battery action than purely a negli- gence action as put forth in the original complaint. Altercation in Hallway During the hearing it was brought out in evidence that both litigants were carrying on a heated conversa- tion in the hallway of the house, which is owned by the defendant After the plaintiff had left and went into the Kitchen, it is alleged that the defendant deliberately followed, pushed the door forcibly and as a ult the plaintiff's hand was caught between the door and a sewing ma- chine. The door was swung with such force as to cause the lower panel to go through the machine, it was testified. After all the plaintiff's evidence was in, Judge Saxe halted . further proceedings and called attention of | | the counsel to the fact that it looked | more like an assault and battery ac- | {tion than one of negligence. It was finally agreed that counsel would take time out to amend the com- plaint to read as of assault.
