Ohio, university were richer by many thousands of dollars today because Dr. James 8. McCarthy was tired of the pitiless publicity that has illumined the affairs of his fam- ily during four days’ probate hear- ing of Mra. Margaret Huntington 8mith McCarthy's $7,000,000 will. The young physician, who mar- ried Mrs, McCarthy—12 years his #enior—three years ago after a short courtship in a sanitarium, was will- ing to sacritice nearly half his in- heritance of $3,600,000 to avoid acandal. Dr. McCarthy will content himself with 55 per cent of the original be- quest, giving 30% per cent to Miss Margaret Gowan, daughter of Mra. McCarthy by the first of her three marriages, and 143% per cent to ‘Western Reserve University, who contested the testament, The settlement was announcd in Judge Stephen L. Radford’s probatc court here yesterday as the sensa- ticnal will contest went into its fifth day. Dr. McCarthy's comprgmise was independent of the will which made the following bequests, James 8. Mc- Carthy, Jr., 18-months-old, $2,000, 000 in trust; Miss Gowan, $200,000; Hubbard C. Hutchinson, $5,000; Pearl Emery, Blue Hill, Me., $2,- 500; Dr. John M. Tucker, $2,600. Mrs. McCarthy’s gift of $264,000 to her husband before her death was not regarded as part of the estate.
