Attorney Harlan. M. Harlan, in a letter addressed to Acting Solicitor Edward Barnes, at the custom House, advised him that Section 17 of the national pro- hibitior act, which prohibits the dis- tribution for liquors, wines and oth- er beverages banned from sale by that act, refers only to advertise- ments of liguor either to be manu- factured, placed on sale or kept for sale in this country. Mr. Harlan stated that in his opinion the advertisements of liquor not in this country fn the Key to —ordinarily a good Tiondon or other foreign magazines L cannot legally be held to constitute value at $325. an offense against federal prohibi- tion enactments. Upon receipt of the letter, Mr. Barnes issued Instructions to re- move all customs restrictions on the magazine and to release it on pay- ment of the regular duties.
