WATER €0 OPENING FIGHT ON RAILR0AD Injunction Forbids Diversion of Mianus River New Haven, July 27 (A—An in- junctien to restrain the New York, New Haven and Hartford railroad company from proceeding with the diversion of waters of the Mianus river in Greenwich for its own use at the power house at Cos Cob, has been signed by Judge Alfred C. Baldwin of the superior court, it was made known today. . The restraint was asked of the court by Col. L. Field who with James F. Walsh of Greenwich, represent the Greenwich Water company, which claims under its charter to Lave rights in the river. Service of the court order has been made on the railroad company officers. ending distribution of the issue the company is held under a penalty of 310,000 to observe the injunction. $500.000 Project The water company claims that the water in the river is needed for demonstration purposes in the town. The New Haven road has spent con- siderable money in planning a dam Jjust north of the Boston post road and when it is completed the outlay would be an estimated half million of dollars. Coffer dams are already in place, and much abutting land has been bought. The water company claims also that it has had a right to take river water since 1880 and that at pres- ent a serious water shortage pends. As to the railroad company’s use of the water the water com- pany claims that the former had no right to develop the water in the river because the railroad company never accepted a legislative act of 1913 “which on igs face gave it that privilege.” In applying to Judge Baldwin for the restraint the water company argued that it has an appeal pending from an order of the public utilities lcommission which favored the rail- road company and that such an peal should have acted as a res jupon the railroad company which lhas gone ahead with its work. The New Haven road company is ordered to appear before Judge John [W.
