{0 RULING YET O VISITING VENDORS Tases of Six New Haven Men Nolled in Superior Court Local authorities were disappoint- cd yesterday afternoon when State's Attorney Hugh M, Alcorn nolled charges of violating the itinerant vendors act against six New Haven men who were found gullty in the local police court and appealed to superior court. The question of {tinerant vendors is one the police lesirous of getting a definite rul- ing on so that a fised policy of deal- ing with men desiring to dispose of lieir wares in this city can be es- tublished. The cage of the New Haven men, Max Kittner, Allen and Max Helsant, Saul and Joscph Bailer and Touls Neuman furnished the best oppor tunity the police have yet had to get such a ruling, but the action of the state's attorney in the case prevent- ed it. Chief Willlam C. Hart of the po- liee department is called upon to pass on the question of permitting men to solicit orders about the city, both by local merchants and by men desiring to take orders for varlous articles. The local merchants fnsist that anybody who comes into the city to sell goods Is providing unfair competition and should be re- strained. In the casa of the slx men from New Haven, thelr attorney Walter J. McCarthy of New Haven, alleged that gince the company they repre- gented was esiablished in the state, they were not liable under the jtin- erant vendors act and should not be prosecuted, 'The action of State's Attorney Aleorn appears to hear out this contention, in spite of the de- cision by Judge William €. Hunger- tord that the men were gullty under the act. Evidence was Introduced in the tocal police court that the men had made direct cash sales to customers and did not follow the usual proce- dure of taking orders for articles and delivering them at a later date, Judge Hungerford fined each man $10. Other Cases Nolled Other cases nolled were those of Richard Long, who appealed a sen- tence to the state farm on a charge of drunkenness; Theodore 8. Dow, who was hound over on a charge of concealing an automobile purchased on a conditional bill of sale; Walter RV ®EW BRITAIN DAILY HERALD, FRIDAY, OCTOBER 2, 1928, STAMPED 90x108 BEDSPREA D, PILLOW TOP, 3-PIECE VANITY SET, PAIR CURTAINS, VALANCE SATURDAY ONLY!
