4 LEWITT RECOVERS DEPOSIT ON GHURCH Supreme Conrt Rules for Him on $6,500 Claim —_— In an opinion written by Judge Keeler in supreme court, Attorney George Le Witt of this city Is allowed recovery on a clalm of $0,500 against e Park Ecclesiastical soclety of Hartford, whose properly he had entered into a contrace to purchase in 1921, and on which he placed a deposit of 85,000, return of which Was refysed when the deal did not &0 through. Mr. Le Witt agreed to buy the church property, standing at the cor- ner of Asylum and High streets, for $225,000, planning to erect a theater on the site. He placed a deposit of $8,000 to llquidate Jdamages in the event he did not huy. One of the terms of the contract was that a deed free of all encumbrance should ®s given the purchaser. When the deed was tendered it was found there were outstanding rights of way hin. dering the passing of such a deed. The society maintained Le Witt had knowledge of the exlstance of these rights of way and they did not con- stityte an encumbrance. Upon the church's refusal to re- turn his deposit, Le Witt brought sult. Judge Newell Jennings in su- perior court ruled for him to re- eover the amount of deposit with interest. An appeal was ghen taken to the supreme court. Le Witt was represented by Judge Bernard 1. Gaffney, Attorncy Don- ald Gaffney of this city, and Attor- ney Josiah H. Peck of Hartford. John T.
