HIDNAPPING CHARGE PRESENTED FIRST Leopold and Loeb Not to Face Murder Count Immediately June 10.—Nathan Leopold, ichard Loeb, admitted Kid- slayers of Itobert Franks, son, will be tried first on ¢ kidnapping for ransom preliminary to their trial on murder charges, s ttorneys have de- »d. Both are capital ofienses, The move is planned to show relative strength of the cases of th presecution and defense, particularly the youths' con concerning whiclh there is doubt their admissability as evidence, State’'s Attorney Crowe, who has not made a court appearance for years, personally will direct the prosecution. Preparations to combat a defense of insanity or pl guilty to ob- tain life gentences are being made by the sta There will be no compro- mise, Mr. Crowe has announced, and any attempt to enter guilty pleas would resuit in dismissal of the cases and re-indictment of the slayers. Pleas of not guilty will be entered for both youths when they are ar- raigned tomorrow, according to Clar- ence 8, Darrow, chief defense counsel. The state will demand an immediate trial and resist any effort to obtain a continuance later than July 15, the earliest possible date, in attempts to cripple the inshity defense in the making, subpoenas have been issued for members of the faculty and more than a hundred students of the University of Chicago, where Leopold and Loeb were stu- dents, to testify regarding their ob- servations as to the mental eonditions of the pair. A professor of an Chicago Jr., and nappers a millionai charges te's the status o ssions, as to eight court as of eastern university has been called be- | fore the grand jury to testify to lLeopold's passing an examination to enter the law school of the institution two days after the killing. Prosecu- tors say they expect to determine if the examination paper ecould have been written by an insane person. The chief discrepancy in the boys' econfeasions—who was driving the au- tomobile in which the Franks boy was kidnapped and slain-—is regarded by the state's attorney as settled by Carl Ulving, a chauffeur, who told State's Attorneys he passed the machine shortly before the kidnapping and Loeb was driving Each youth has accused the other of being tn the rear seat of the automoblle and doing the killing. Ulving said he knew Loeb quite well and had waved to him as he passed and that Loeb returned the salute. The portable typewriter used in composing the wvansom letters and found in a park lagoon Baturday, has been traced as the stolen property of A Unl*ersity of Michigan student, who said it disappeared from his room during the Christmas bolidays.
