The technicality on which it is hoped | to secure this relief for Miss Cox is the fact that the alleged destruction by fire of the dwelling, cotton gin house, warehouse and other buildings | on the plantation occurred three days |after the Civil war was officially ended. 1t was thus, technically, not an act of war, though the soldiers responsible | had not yet received the news of the sation of hostilities. In support of the claim, have been | presented several affidavits of former | negro slaves on the plantation, which belonged to Miss Cox's late father | Jesse J. Cox, and was located in Mont- ignnwry county, Alabama. These af- | fidavits describe the alleged incendia- | rism of the Union soldiers. They were One of the affidavits is by a formér slave named Berry Pinkston. He de- scribes the visit to the Cox farm “in the early part of the year 1865, of a | federal cavalry squad which he be- lleves belonged to the command of & | general, or colonel, Wilson. He swears that he witnessed the soldiers set fire to the dwelling, kitchen, cot- ton gin house, another old dwelling, | the warehouse, 250 bales of cotton, | cotton seed, carriage stable and car-| nge and other places on the planta- | |tion and adds that the alleged marau- |ders led away several horses. He himself, the negro swears, was| forced to accompany the cavalry squad as far as Columbia, Ga., where, | he states, he managed to escape nnd‘ return to the plantation. | ; ‘When all this happened, Miss Cox | |was a young girl, about eight or 10 | years old, but she is said to remem- ber the events of that day very clear- | ly. But she has spoken of them very | rarely, preferring to live out her life | in retirement becoming a belle of the old south.
