Wagner Tells of Husband’s Alleged Misconduct New York, July 28.—A situation closely linked up with Broadway's night life, which Broadway has |known about, but concerning which the general public has heard anly vague rumors, was brought out into the open yesterday when complaint and affidavits in Mrs. Charles C, Wag- ner's divorce action were filed in the county clerk's office Charles C. Wagner owns a half in- terest in the Club Maurice, No. 208 West 51st street, until recently one of Broad most popular after-thea- ter resorts. Not the least {nteresting of the many allegations in affidavits of Mr. and Mrs. Wagner is his assertion that it is due to domestic difficulties that the Club Maurice has heen dis- possessad and its further operation |made highly douhtful The woman whom Mrs, Wagner ac- cuses of repeated acts of misconduct | with her husband is T.illian Lorraine, musical comedy actress, who recent- ly starred in “The Blue Kitten." The raid on which Mrs. Wagner bases her most specific charge of wrongdoing, occurred, according to the papers, in an apartment occupied by her husband and Miss Lorraina at No. 120 West 71st stree t 3 o'clock on the morning of May Tells of Raid. the An affidavit by Lulu Caldwell, Mrs, Wagner's maid, tells of the raid. Len- igan, who owns the other half interest, told her they had engaged Florence Walton, guaranteeing her $1,250 a week and increasing it to $2,000 for any week she draws 1,700 people to the restaurant and to $2,500 if she attracts 2,000 patrons. Mr. Wagner, who claims he drew only §150 weekly salary from the Club Maurice, sweavs even that is gone now. Sinea his wife started her acr tion, he states, the club defaulted on the payment of a month's rent, amounting to $1,000, and they were dispossessed and the premises leased to a competitor. He claims he gave his wife $16,000 to keep for him and that she gave him back only $5,000. Had she not refused to return the remainder to him, he says, he would have been able to save the corporation, “but as a result of my wife's own acts,” he state, ‘“she has made {t impossible for me to pay any alilmony or counsel fees whatever in this action.” Wagner Denies Misconduct. Mrs. Wagner, in her answer, claims a loan of many thousands could have been rafsed on the club's equipment. She charges her husband took a six days’ trip with Miss Lorraine and three others to Fldridge, N.
