Hartford, April 28.—Lawrence Fer. ‘ rone, sentenced to prison for five to 30 years in the Hartford county crim- inal court last October by Judge Frank D. Haines as an habitual crim- inal, was today granted a new trial by the Connecticut supreme court. The opinion is written by Justice | Burpee, who finds error in the trial ' in the lower court, saying that intro- duction of testimony relative to a pre- vious offense is bound to influence a jury and prevent them from render- ing a just decision. Ferrone was charged with having | in his possession burglar’s tools and instruments of housebreaking, and when arrested was riding in a car with three companions. The others and a fourth gun was found behind the cushion of the seat where Ferrone was sitting. The others were finally sentenced to state prison but Ferrone was discharged.
