Three pool balls were found in the street Informa- tion was furnished the police that the five accused had been in the place earlier in the evening. Patrolman John Kennedy was detailed to bring them into headquarters where they were identified: Lynch's eye was cut when arrested. Hickey told the court| that his party had purchased a round of ciders after which a second drink was called for by each of the men. A drink, much sweeter than the first, was served. After tasting it the party refused payment since it was not as ordered. The bar-keeper then hit Jerry Lynch with a broken bottle, cutting his wrist, whereupon Hickey pushed him and they made their get- away As they were leaving some- one threw pool balls, Hickey said, breaking the window. Lynch's teéstimony was of a simi- Iar nature. He claimed that his wrist was cut when payment was re- fused for the drink served and that he backed away from the fight, leav- ing his friends to battle with what he estimated to be a thousand Span- lards. He did not know who broke the window. The other three ac- cused offered similar explanations. Hickey was of the belief that there were 100 Spaniards in the place; Lynch thought there was a thousand, and Cardis thought a million sons of Spain’ piled on his party. Paris, Dec. 29.—The foreign office was advised today that the German government delivered a note yesterday to the allied representatives in Berlin protesting against the recent note of General Nollett, head of the inter- allied commission of control in Berlin with regard to the failure of the Ger- man government to disband the civic { guard. The German notes say that the suc- cess of the Brussels conference is likely to be affected if the Allies per- sist in the line of action they have taken concerning the police investi- gation. Washington, Dec. 29.—The House of Representatives had arranged to pause today for an hour or more in its conmsideration of appreciations, taxation and other governfental mat- | ters to pay tribute to its “grand old man” “Uncle Joe” Cannon. Establishment by Representative Cannon of a new record for length of service in Congress was the occa- sion for the celebration. The former speaker set the new mark yesterday, surpassing in length of service Justin Smith Morrill, of Vermont, who pre- viously had held the record of 43 years, nine months and 24 days in the house of senate. Mr. Cannon long ago exceeded all others for length of serv- ice in the house and last November was elected to the house for the 23rd time. ALLIES TO MEET IN LONDON.
