The evidence on hand in Circo's case would not warrant holding him, Lawyer Greenberg said, although he was canfidently sure that the accused was a whiskey-runner. The arrest of Shapiro in his home on Lafayette street Thursday night followed an investigation by Patrol- man Edward Kiley of information which he had been given concerning alleged liquor traffic. He enlisted the services of William Tuskowski to as- sist tn securing evidence. Tuskowski was sent into the houe with a marked $2 bill and a half dollar, with which he was ordered to purchase a pint of liquor. He returned shortly afterward with the liquor and minus the money. Policemen Kiley, Feeney, McCabe and Sergeant Hart entered the apartment where they found Shapiro with the marked bill. A search of the house failed to reveal traces of more liquor. Upomt the evidence secured, he was placed under arrest. ‘While the police were in the house, Circo entered. He had a small bottle of whiskey in his pocket which he admitted was a “‘sample” with which he was seeking to make sales. He had not sold any liquor, however, he told the police and was going to give up the job. Lawyer M. D. Saxe for the accused, said this morning that he had pur- chased the liquor for use over the holidays and as he had no use for it he agreed to sell the bottle to Tuskowski. He made money on ft, Lawyer Saxe said.
