Sergeant Theodore Johnson and James White, the latter representing the Conn cut Humane society, Vv ited the barn in which Comnick keeps his horte and found that the place was not kept clean and that the horse had been given garbage for his feed. Mr. White stated that he told Comnick to have the stables cleaned and to buy more feed for the horse. Comnick did not pay any attention to these orders and when the barn was again visited, Sunday afternoon, the same conditions prevailed, with the exception that there were a number of meat hones in the stall which evi- dently had been placed there as feed for the hors Attorney avid L. peared for the accu court to discharge hi; ground that although there was no feed in the stall the state had failed to prove that the horse had not he fed. Found guilty * of sweater valued at $2 cents from thc Fair department store yesterday afternoon, a fine of $7 and costs wu imposed upon Joseph Bocella Judge Meskill. At the same time, while the clerk wa ping up the purchase, it is stole one of the sweaters which was lying upon the counter, placing it inside his overcoat. The clerk, notice ing that Bocella's coat bulged out on one side, called Mr. Leventhal, the manager, who accosted Bocella, ask- ing him what he had in his coat Bocella at first refused to open coat, but when he was told that =a policeman had been called, he put his hand under his coat, took out the sweater and threw it upon the coun- , ter. Mr. Leventhal stated that Bo- ! cella offered to pay him for the stolen article, stating fthat he had acci- dentally picked’up the sweater when he took up his bundle which had been wrapped up at‘the sweater counter.
