The victim died morning and Nappi was arrested within few hours at the home of his sister-in-law, Mrs. A. Nappi of 70 Cherry street, cha of man- slaughter being brought following the report of attending physicians that the wound had been {he primary cause of death. Brought to the stu- tion he immediately denied guilt and his plea of not guilty will accompany the charges to the superior court. Brown Saw Whole Affair. Leo Brown, star witness for the state testified this morning and gave damaging evidence to indicate the guilt of the accused. He is a roomer in the Park hotel, he said, and on the evening of October 11 went to his room. When he felt in his pockets for the key to the door he found it missing and returned to the office of the hotel. There he met Charles Asal who advised him to see the watchman of the building and get a k from him. Asal agreed to show him where the watchman’s room was and together they started. Coming to the door they knocked several times and failing to receive an answer began to pound louder whereupon Nappi called from his room above to “shut up.” Asal objected to his interference and lost no time in in- forming Nappi that it was none of his busin evening of nesday Victim Is Knifed. Brown and Asal went to the floor above and the accused came to blows with his victim. Both rolled on the floor, Brown testified, and in a mo- ment he heard Asal shout: “‘Gee! He's got a knife. He got me!" According to the testimony Asal stood up and Nappi ran. The vietim then doubled up and fell to the floor in a faint. Nappi then ran to his room and locked the door and Brown after a futile attempt to catch the accused returned and found the blood soaking its way .through the clothes of the injured man. Fle called for a ce and Dr. Williamy Flan- agan was summoned ordering the im- mediate removal to the hospital after Officer Michael Flynn had gone over the ground for evidence. Officer Gets Eviglence, In the meantime, according o in- formation in the hands of the police, the accused went to the window of his room and dropped by the aid of a rope four stofies to the ground be- low. There he picked himself up and in his haste left a derby hat which he had been wearing behind. Officer Flynn in his investigation came across the hat and brought it to the station when he Jodged his report of the fray. AL 12 4 . The policeman inquired ahout the knife and the stabbing but fo hoth questions the accused merely shrug- ged his shoulders. lle was brought to the police station, arraigned on a plain ault charge and allowed to go in bonds of $25 the following morning to await trial when Asal should be discharged from the hos- pital. Doctor’s Testify. Dr. & Goda, Japanesc house doctor at the local institution examined the injured man when he was admitted and found him suffering great pain. A wound about half an inch long was found in his abdomen and was dressed by Dr. Goda During his confirement to the los- pital Dr. George Dunn was In charge of the patient and he gave a descrip- tion of the wound today. He believed it to have been inflicted with a sharp- pointed instrument and the tissues of the stomach had been severed in such a way as {o indicate a forceful Tunge with the weapon. The immediate cause of death was the removal of the intestinal obstruction. he testified, while the primary cause was the wound. Dr Ifox was called in consultation to examine the wound on the day fol- Jowing the fray and told of his obs vations Nappi Is Quict. Asked if he had anything ta say re- garding the fight or his connections with it, and warned that anything he would say would be used against him in case his case went over to the su perior court, Nappi replied throug Court Interpreter Lacava that he had nothing to say.
