Telephone 223 McCormack G_ets 30 Days, $15 and $10—0ther Cases Stating that the practice of beating policemen was going to hbe discon- tinued even if it was found neces- sary to send everyone brought in on this charge to jail, Judge Meskill im- posed a 30 day il sentence upon Frank McCormack, an ex-soldier, in police court today for resisting and assaulting Officer Charles Johnson, and fines of $10 for drunkenness and $15 for breach of the peace. The accused was arrested in front of the Palace theater yesterday afternoon following a tussle with Officer John- son after he had been placed under arrest for cauging a disturbance on a trolley car Tears Conductor’s Coat. McCormack, according to William Gubbhins, the conductor on the car, boarded the trolley due into the cen- ter at 5:33 at the corner of Hartford avenue and North street. When Gub- bins went to him for his fare Mec- Cormack said, *“201” which the con- ductor took as an indication that he was a member of the 20lst regi- ment in France. He became abu- sive and refused to pay when asked again and also refused to allow a friend who was with him at the time to pay. The accused used vile lan- guage and.as many of the women insisted upon having the car stopped to allow them to leave Gubbins closed the door leading into the trolley, leav- ing McCormack on the rear platform. He resented this, however, and taking Gubbins by the sleeve of the coat ripped that part of the garment al- most entirely off. Officer Johnson Assaulted. The motorman, Michael O'Brien who is also a supernumerary police- man stopped the car at the Palace and called to Officer Charles John- son, then on traffic duty at the cor- ner ,of Main and East Main streets. McCormack jumped from the car and shouted, “Johnson, you nor nobody else will ever arrest me.” As the po- liceman walked toward him the ac- cusel jumped on him and both fell to the ground. When they came up Officer Johnson had his man held se- curely but his uniform coat was torn almost beyond repair. Officers O'Brien and Daniel Cosgrove came to his as- sistance and held the crowd back while McCormack called to ali his friends to assist him in beating John- son. Remembers Nothing, Although he gave his name cor- rectly at the desk in the police sta- tion when brought in, McCormack stated in court today that he could remember nothing concerning the in- cident which led to his arrest. Ile had been under the influence of liquor since early morning. he said, and could not recall getting on the trol- ley, Tefusing Gubbins the fare, tear- ing his coat nor resisting and beat- ing Officer Charles Johnson. In requesting that judgment be suspended his attorney, Judge Wil- liam 1. Mangan argued that his physical condition would be serious- ly impaired if confined. He felt, he added, that a jail sentence suspend- ed would tend to straighten his client out to which Prosecutor Klett re- marked, “Nothing could straighten him out.” This is his third arrest for breach of the peace and drunken- ness in a few months. Placed on Probation. As there was no evidence than hearsay upon which to conviet the accused, John Bernos charged with implication in the theft of a horse from James White's livery stables on the third of July and the returning of the horse in poor con- dition on the following morning, was continued on probation. Two other boyvs, one of them a sailor in uniform were before the judge July 5 for the same offense and Bernoskas was accused by them. The boy claims that he rode with the other boys from Central park to Lawlor street but {hought the horse had heen hired. The animal was taken, according to Mr. White about 9 o’clock on the evening of the 3d and returned at 6 the following morning.
