Nothing quite equals Linonine for bronchitis, BURLESON LOSES ON PHONE RATES Pennsylvania Will Continue Under Original Prices | Harrisburg, Pa., April 3.—The com- monwealth of Pennsylvania has won its second round in the injunction pro- ceedings to prevent Postmaster-Gen- | eral Burleson, acting as the federal! operating agent of the Bell Telephone company, from raising telephone rates in this state. Judge Kunkel of the Dauphin county courts handed down an opinion in which he continues until a final hearing has been held the pre- liminary injunction granted against the BRell company. The case involves the right of fed- eral authorities to override state sta- tutes in the matter of fixing public service rates. By vesterday's opinion the Bell company is restrained from putting into effect the telephone schedules promiulgated by Mr. Burle- son and which the Bell company was ordered to put into effect in violation of the laws of Pennsylvania with re- gard to change in rate schedules, Judge Kunkel says 1t is his opinion that ‘peither the president nor the postmaster-general was acting offi- cially in changing the rates and tolls, but that they acted beyond the scope of their powers.” Upholds State’s Contention. I'he court reviews f(he conditions leading up to the change of rates quoting the resolutlor. under which the telephone lines were taken over as a war emergency by the govern- ment, and holds that the common- wealth's contention that this resolu- tion did not contemplate rate changes is well taken. The-e no attempt to deny the | power of the president to operate the lines for war purposes but Judge Kunkel says: “The rates he charges others whom he may permit the use of the lines white under his control would seem to have no real relation whatsoev to his use of the system for all proper war purposes. Hence it would appear that his attempt to change the rates and enforce rates which are not ap- proved by the state authorities is wholly outside his power.” Further the judge says: “YWhen the presidert attempts to | use the defendant’s lines, and it does not appear that it is for a war pur- pose, but on the contrary appears to be for a purpose having no apparent or direct relation to the prosecution of the war., it must be shown, we | take it, that he is using it for a la ful and constitutional end. The ne cessity out of which his power arises does not appear in the present case.” Refers to Constitutional Powers. It would hardly be contended, says the opinion. that if he took possession of private property under what s called his war powers and used it for other than war purposes he was act- ing within his constitutional powers. Tt may be suggested, the court says, that it is the duty of the pres- ident to attempt to avoid loss to the company, but it holds that in the absence of facts and findings it must be presumed that the rates approved | by the public service commission are fair and reasonable. April 1, (By The Asso- clated Press).—Repeated Bolshevik attacks along the front line and both the right and left flank positions con- troiling Odozerskaia were repulsed today by Allied forces The Amerir cans, French, British and Russians, who, either soparately or together, are holding positions throughout this ter- ritory, which is a little over 100 miles south of Arcnangel, have everywhere held their lines intact. The Bolsheviki, in spite of their heavy losses yesterday, attacked the _railroad front south of Odozerskaia at ten o’clock this morning but they fajled. Allied forces east of Bolshofa Ozera, where Americans, Ruesians and British are fighting were under attack all day yesterday at a point about 16 miles west of Odozerskaia and four separate assaults were made there again early this morning. All broke down under the Allled fire. Ac- cording to Bolshevik prisoners, the enemy is somewhat demoralized be- cause of his heavy losees during the past two davs. In the B8eletzkoe sector, 40 miles east of Odogerskaia, the Allied ad- vanced posts were attacked by a strong enemy patrol this morning, but the RBolgheviki were driven back by | machine gun fire, losing two killed and a number wounded. Seletzkoe protects the Allied flang along the Odozerskaia front and the right flank !nf the Allied river front positions. i On the Nnrega river west of Bol- | shoia Ozera. the enemy yesterday shelled the village of Kleshevo, which is held by a Russo-Buitish garrison.
